CHAP. 124. An ACT to validate, ratify, approve and confirm the transfer
and conveyance from the county of Clarke to the Commonwealth of
Virginia, heretofore made by resolutions of the board of supervisors
of Clarke county, of the Berryville and Charles Town turnpike in
Clarke county, the Winchester and Berry’s Ferry turnpike in Clarke
county, and the bridge over the Shenandoah river at Berry’s Ferry in
Clarke county. [H B 105]

Whereas, the Winchester and Berry’s ferry turnpike in
Clarke county was declared abandoned and was placed under
the control of the board of supervisors, by order of the circuit
court of Clarke county, made in accordance with the statute for
such cases provided; the Berryville and Charles Town turnpike
was transferred to the board of supervisors of Clarke county by
act of the general assembly of Virginia, approved March first,
eighteen hundred and eighty-four; and the bridge over the
Shenandoah river at Berry’s ferry in Clarke county was con-
structed under authority of an act of the general assembly, ap-
proved December tenth, one thousand nine hundred and three,
and the title to said bridge was by said act vested in the county
of Clarke; and,
Whereas, the State highway commission proposed to take
over for maintenance as a part of the State highway system,
on and after September first, one thousand nine hundred and
twenty-two, the aforesaid turnpikes and bridge, upon condi-
tion that the same be transferred and conveyed to the Common-
wealth of Virginia; and, ,
Whereas, the said offer of the State highway commission,
in the opinion of the board of supervisors of Clarke county, con-
stituted a valuable and adequate consideration for the transfer
and conveyance of the said turnpikes and bridge therein pro-
posed, and it was deemed by said board for the best interest of
the county that the offer should be accepted; and,
| Whereas, the said board of supervisors did therefore accept
the said offer, and did by appropriate resolutions transfer and
convey the said turnpikes and the said bridge to the Common-
wealth of Virginia, and the same have been taken under con-
trol by the State highway commission for maintenance as a part
of the State highway system; therefore,
1. Be it enacted by the general assembly of Virginia, That
the transfer and conveyance from the county of Clarke to the
Commonwealth of Virginia of the Berryville and Charles Town
turnpike in Clarke county, the Winchester and Berry’s ferry
turnpike in Clarke county, and the bridge over the Shenandoah
river at Berry’s ferry in Clarke county, as heretofore made by
the resolution of the board of supervisors of the county of
Clarke, be, and the same is hereby validated, ratified, approved
and confirmed, and the title to the said turnpikes and bridge
shall be thereby vested in the Commonwealth of Virginia.
