Chap. 405.—An ACT to amend and re-enact section 4439 of the Code of
Virginia. {H B 151]

1. Be it enacted by the general assembly of Virginia, That sec-
tion forty-four hundred and thirty-nine of the Code of Virginia be
amended and re-enacted so as to read as follows:
Sec. 4439. Same act, with intent to commit larceny; how pun-
ished; robbing bank; how punished.—If any person do any of the
acts mentioned in the preceding section, with intent to commit lar-
ceny, or any felony other than murder, rape, or robbery, he shall be
confined in the penitentiary not less than one nor more than ten
years, or, in the discretion of the jury, confined in jail not exceeding
twelve months, and fined not exceeding five hundred dollars. If any
person, armed with a deadly weapon, shall enter any banking house
in the day time or in the night time with intent to commit larceny
of money, bonds, notes or other evidence of debt therein, he shall be
punished with death, or, in the discretion of the jury, by confinement
in the penitentiary not less than five nor more than eighteen years.
