Chap. 508.—An ACT to amend and re-enact section 3488 of the Code of Vir-

1. Be it enacted by the general assembly of Virginia, That sec-
tion three thousand four hundred and eighty-eight of the Code of
Virginia be amended and re-enacted so as to read as follows:
Sec. 3488. Officer entitled to fee for making return on executions
when no levy made or forthcoming bond taken—-Whenever on any
decree or judgment in a civil case any fieri facias issued by the clerk
of any court or justice of the peace is placed in the hands of any
officer and no levy is made or forthcoming bond is taken thereon, and
a return is made by said officer, the said officer so making a return
thereon shall be allowed a fee of fifty cents for making said return.
In any case where such officer makes a levy and by reason of a
settlement between the parties to the claim or suit, the officer is not
permitted to sell under such levy, he shall nevertheless be entitled to
recover from the party, for whom the services were performed, one-
half the commissions for such levy.
