Chap. 49.—An ACT to authorize the board of supervisors of Bath county to
condemn land and material in Highland county, under certain conditions,
for road purposes. (H B 99]

1. Be it enacted by the general assembly of Virginia, That when-
ever, in the opinion of the board of supervisors of Bath county, it is
necessary or expedient, on account of topographical conditions, for
that county, in locating and building a road to connect two or more
points in the same, to run the said road over a part of the territory of
Highland county and then back into the first named county, such
course being followed for reasons of economy and for the convenience
of the first-named county and such road being of no material benefit
to the citizens of the other county, the board of supervisors of the
first-named county may acquire by purchase, or may condemn so much
land as may be necessary for a right of way over the territory of the
other county, by proceeding under the provisions of chapter one hun-
dred and seventy-six of the Code of Virginia before the circuit court
of the said other county, or the judge thereof in vacation. Such
condemnation proceedings shall be at the expense of the county insti-
tuting the same, and after the said right of way shall have been ac-
quired, the road shall be built and maintained wholly at the expense
of the county acquiring the right of way. This act shall be construed
to authorize also the condemnation in like manner, of such sand,
earth, gravel and other road material as may be necessary for the
building of the road and maintaining the same.
2. An emergency existing, this act shall be in force from its
passage.
