Chap. 410.—An ACT to ardeud. and re-enact sections 3665, 3666, 3667. 3673 and
3674 of the Code of Virginia of 1919. [S B 168]

1. Beit enacted by the general assembly of Virginia, That sections
three thousand six hundred and sixty-five, three thousand six hundred
and sixty-six, three thousand six hundred and sixty-seven, three thou-
sand six hundred and seventy-three and three thousand six hundred
and seventy-four of the Code of. Vitginia of 1919 be amended and
re-enacted so as to read as follows:
Sec. 3665. Harbor commissioner for Norfolk, Portsmouth and
Norfolk county.—For the purpose of preserving uniformity the harbor
of Norfolk, Portsmouth and Norfolk county, there shall be appointed
a board of harbor commissioners to consist of seven persons, three of
whom shall be appointed by the council of the city of Norfolk, two
by the council of the city of Portsmouth, and two by the judge of the
circuit court of the county of Norfolk.
Sec. 3666. Their term, election of officers, quorum, compensation.
—The said commissioners shall respectively hold their office for the
term of four years, commencing on the first day of January, nineteen
hundred and twenty. They shall be known as the board of harbor
commissioners of Norfolk, Portsmouth and Norfolk county. And a
majority shall constitute a quorum. They shall elect one of their
members president, and such other officers as they deem necessary.
Any vacancy occurring in the board shall be filled by the same authority
which made the appointment. Each of said commissioners shall re-

ceive the sum of ten dollars for each quarterly meeting at which he
may attend.
Sec. 3667. Jurisdiction of board.—The jurisdiction of said board
for the purpose of this chapter shall extend to the Elizabeth river and
all the branches and tributaries thereof, along the water front of the
cities of Norfolk, Portsmouth and Norfolk county. They shall have
power to fix, locate, and from time to time relocate, regulate and
define the lines along said river and the branches and tributaries
thereof within which riparian owners may erect wharves, piers, docks
and other proper structures and fixtures for commercial and manufac-
turing purposes; provided, that whenever any harbor lines have been
or may be hereafter established under authority of congress by any
proper officer of the United States, in any of said waters, the power
herein conferred upon the said board of harbor commissioners shall
only be exercised within the lines so established, but they may regulate
such structures as may be erected and prevent all encroachments upon
said lines. ~
Sec. 3673. The said board shall appo?nt annually three harbor
masters who shall be licensed masters of steam vessels, one of whom
shall be a qualified voter of the city of Norfolk, one a qualified voter
of the city of Portsmouth, and one a qualified voter of Norfolk county,
none of whom shall receive any emolument or other benefit or com-
pensation from the United States government, who shall act within the
jurisdiction of said board, and. whose jurisdiction shall be co-extensive
with the jurisdiction of the said board. The said board may prescribe
the duties of such harbor masters, fix their compensation, and remove
them at pleasure.
Sec. 3674. For the purpose of defraying the necessary expenses in-
curred by the board in exercising the powers hereby conferred, the
county of Norfolk shall be assessed and shall pay one-fourth of the
estimated expenses thereof, the city of Portsmouth, one-fourth thereof,
and the city of Norfolk, one-half thereof; provided that the mainten-
ance of said board in exercising the powers hereby conferred and
maintenance of the boat hereinafter mentioned shall not exceed four-
teen thousand dollars per annum; but the said commissioners shall
receive no compensation for their services other than as provided
in section thirty-six hundred and sixty-six hereof, except it be allowed
by their respective corporations and the board of supervisors of Nor-
folk county, in which case, the corporation or board of supervisors
making such allowance shall provide for the payment of the same.
The cities of Norfolk and Portsmouth and the county of Norfolk
shall provide a suitable boat, to be selected by the board of harbot
commissioners, at a cost of not to exceed twelve thousand dollars for
the use of the harbor masters for the proper performance of their
duties. For the purchase of the said boat, the city of Portsmouth shall
pay not to exceed three thousand dollars, the county of Norfolk, not
to exceed three thousand dollars, and the city of Norfolk, not to
exceed six thousand dollars, and in the event that the purchase price
of said boat is less than twelve thousand dollars the actual purchase
price therefor shall be prorated among and paid by the county of
Norfolk, the city of Portsmouth and the city of Norfolk in the pro-
portion above set forth, said boat to be maintained and operated out of
the. funds hereinbefore provided for.
