Chap. 384.—An ACT to amend and re-enact section 5898 of the Code of Vir-
ginia, and to repeal an act entitled an act to amend and re-enact section
3049 of the Code of Virginia, relative to temporary appointment of circuit
judges, approved March 18, 1918. [H B 425]

1. Be it enacted by the general assembly of Virginia, That sec-
tion fifty-eight hundred and ninety-eight of the Code of Virginia be
amended and re-enacted so as to read as follows:
Sec. 5898. Power of judges to hold courts other than their own
and their pay—The judge of any circuit court, or of.any city or
corporation court of record may hold any other circuit or city cor-
poration court, in any county or city, at the request of the judge of
said circuit or city or corporation court, and in case of the disqualifica-
tion or the inability of the judge thereof to serve, and upon the re-
quest of the governor, shall do so.
For any service rendered by any such judge, for another judge.
under this section, where the judge for whom the service is rendered
is prevented from sitting by sickness, during a part or the whole of
a term, or be so situated in respect to anv cause pending in said court
2S, in its opinion, to make it improper for him to try it, he shall re-
‘eive mileage and ten dollars per day, for the time he is actually
‘ngaged in holding court; such mileage and compensation to be paid
sut of the treasury of the county or city in which said court is held.
2. An act entitled an act to amend and re-enact section thirty
1undred and forty-nine of the Code of Virginia relative to temporary
\ppointment of circuit judges, approved March eighteenth, nineteen
1undred and eighteen, is hereby repealed.
