Chap. 320.—An ACT to authorize the board of supervisors of Nottoway county
to establish road districts and levy a special tax in such districts for road
improvements and maintenance. ' [H B 497]
Approved March 19, 1920.
1. Be it enacted by the general assembly of Virginia, That the
board of supervisors of the county of Nottoway, be empowered to
designate any specific territory in said county as a road district by
name or number, and to make as many of said road districts as it
may see fit from time to time, giving to each one a new name or
number. And upon a petition as hereinafter prescribed, in addition
to the levies for State, county and district purposes the board may
levy a special tax not to exceed one per centum on each one hundred
dollars assessed value of all property in such road district for improv-
ng or maintaining the roads within such district. But no such ‘tax
shall be levied on such property as is under general law segregated
‘o the State for purposes of taxation. a
_ 2. The said special tax shall be levied by the board of super-
visors Only for such years as it may be petitioned to do so by two-
thirds of the land owners residing in such road district, and only
for such amount as such petition may request.
3. A road district when once established shall only be changed
by a petition to the board signed by two-thirds of the land owners
residing in such district, and with the approval of the board of super-
visors.
4. The treasurer of the county shall collect said levy as he does
all other taxes, with the same powers of distress, and shall pay the
same out by proper warrant drawn thereon, and the money collected
from this levy shall always be kept separate and distinct from all other
funds of the county and districts, and shall be applied only to the
maintenance, improvements and construction of roads within the ter-
ritory in which levied, and any treasurer, or board of supervisors, or
road superintendent, or other person, applying or using such money,
or any part thereof, for any other purpose shall be liable therefor.
5. A majority of the voters in such road district, qualified at the
election preceding the time of such appointment, may petition the
board of supervisors for the appointment of some person to overseer
such road work in such district at such compensation as may be
prescribed in such petition, and the board may make such appoint-
ment or the board may refuse to make such appointment, or to pay
the compensation named, but it shall spend no part of said fund
should it refuse to make such appointment or fix the overseer’s com-
pensation in excess of that prescribed in said petition. Said overseer
when appointed shall qualify before the clerk of the circuit court of
Nottoway county and give bond with approved security in such penalty
as the board of supervisors may prescribe. His term of office shall
be for such time as the board may designate, and he shall be removable
at the pleasure of the board, and another appointed as hereinbefore
prescribed. Said overseer shall settle his accounts with the board as
often as it shall require, which shall approve all proper accounts and
vouchers. Said petition may ask that such road work be done by the
county road superintendent in which event he shall receive no addi-
tional compensation therefor, and no part of his salary shall be
charged to said fund hereunder provided for. In the event there
should at any time be presented to the board under this section more
than one petition for the appointment of an overseer, no one of which
is signed by two-thirds of the qualified voters, the board shall disre-
gard all petitions and make such appointment and at such compensa-
tion as it sees fit, or assign such road work to the county road super-
intendent, using the funds raised hereunder in such manner as i
sees fit in working the roads in said district.
6. All work done on any public road, whether done by an over.
seer as herein provided or otherwise, and from wherever the func
or revenue therefor may be derived, shall be under the control and
lirection at all times of the board of supervisors and its agents.
7. An emergency existing, this act shall be in force from its
massage.
