Chap. 283.—An ACT to amend and re-enact section two of the road law of
Montgomery county, as approved March 24, 1910. [H B 380]

1. Be it enacted by the general assembly of Virginia, That section
two of an act approved March fourteenth, nineteen hundred and ten,
as heretofore amended, entitled an act to provide for the working and
keeping in repair the public roads and bridges, and to regulate the
manner of opening new roads in the county of Montgomery, be
amended and re-enacted so as to read as follows:
Sec. 2. There shall be elected by the qualified voters of each
magisterial district of Montgomery county, at the general election
held in November, nineteen hundred and twenty-one, and every two
years thereafter, one road commissioner, who shall be a resident of
the district for which elected, and shall hold his office for a term of
two years, beginning on the first day of January following his elec-
tion. Whenever a vacancy occurs in the office of road commissioner,
the board of supervisors shall appoint a successor for the unexpired
term. Before entering upon the discharge of their duties, the said
commissioners shall qualify before the judge or clerk of the circuit
court of said county, by taking and subscribing to the oaths pre-
scribed by law for all officers, and shall enter into and acknowledge
a bond in such penalty as may be required by the judge or clerk, so
that the same be not less than five hundred dollars nor more than
one thousand dollars, which bond shall be payable to the said county
with conditions for the faithful discharge of his duties. A recovery
on any such bond shall be for the benefit of the road fund of the
district of the county for which the commissioner was elected or
appointed. Each road commissioner, together with the supervisor of
the district, shall constitute the road commission for said district, and
shall have general supervision over all the roads and bridges in their
respective districts, which road commission shall appoint as many
road. foremen as may be hecessary for their respective districts.
2. All acts and parts of acts in conflict with this act are hereby
repealed.
