Chap. 161.—An ACT to amend and re-enact section 3905 of the Code of Vir-
ginia. [S B 268]

1. Beit enacted by the general assembly of Virginia, That section
thirty-nine hundred and five of the Code of Virginia be and the same
is hereby amended and re-enacted so as to read as follows:
Sec. 3905. Discrimination.—If any transportation company shall,
directly or indirectly, by any special rate, rebate, drawback, or other
device, charge, demand, collect, or receive from any corporation, per-
son, or persons, a greater or less compensation for any service ren-
dered, or to be rendered in the transportation of passengers or prop-
erty, subject to the provisions of this chapter, than it charges, de-
mands, collects, or receives from any other corporation, person, or
persons, for doing for him or them a like and contemporaneous ser-
vice in the transportation of a like kind of traffic under substantially
similar circumstances and conditions, such company shall be deemed
gulty of unjust discrimination, which is hereby prohibited and de-
clared to be unlawful, provided, however, that nothing in this section
nor in section thirty-nine hundred and six of the Code shall operate to
prevent a transportation company, subject to the approval of the
State corporation commission, from making and entering into a con-
tract with any newspaper or other publication, published in this State,
agreeing to issue and furnish transportation to such newspaper or
other publication at the rates established by the published rates and
tariffs of such transportation company in exchange for advertising
in such mewspaper or other publication, charged for at regularly
established rates. A copy of any such contract shall be filed with
the commission.
