Chap. 122.—An ACT to repeal section 3 and to amend and re-enact sections
4 and 5, and to enact section 5-a and section 2l-a, and to amend and re-
enact sections 34, and 39, and 44, 49 and 57, of an act entitled an act to
amend and re-enact an act entitled an act to provide for a new charter
for the town of Farmville, approved February 10, 1890, as amended by an
act to amend and re-enact section 18 of the charter of the town of Farm-
ville, approved February 9, 1898; and as amended by an act to amend and
re-enact sections | and 13, and 21, of an act entitled an act to provide a new
charter for the town of Farmville, approved February 20, 1900, as amended
by an act to amend and re-enact section 21 of the charter of the town of
Farmville, approved February 8, 1901, as amended and re-enacted by an act

1. Be it enacted by the general assembly of Virginia, That section
three be repealed and that sections four and five be amended and re-
enacted and that sections five and twenty-one-a be enacted, and that
sections thirty-four, thirty-nine, forty-four, forty-nine and fifty-seven
of an act entitled an act to amend and re-enact an act entitled an act
to provide for a new charter for the,,town of Farmville, approved
February tenth, eighteen hundred and ninety, as amended by an act
to amend and re-enact section eighteen of the charter of the town of
Farmville, approved February ninth, eighteen hundred and ninety-
eight, and as amended by an act to amend and re-enact sections one,
thirteen and twenty-one of an act entitled an act to provide a new
charter for the town of Farmville, approved February twenty, nine-
teen hundred, as amended by an act to amend and re-enact section
twenty-one of the charter of the town of Farmville, approved
February eighth, nineteen hundred and one, as amended and re-enacted
by an act approved March twelfth, nineteen hundred and twelve, be
amended and re-enacted so as to read as follows:
Section three be, and the same is, hereby repealed.
Sec. 4. The municipal authorities of said town shall consist of a
mayor and nine councilmen, who shall be elected on the second Tuesday
in June, nineteen hundred and twenty, and on the second Tuesday in
June every second year thereafter by the qualified voters of the town.
All persons qualified to vote in said election shall be eligible to either
of said offices.
Sec. 5. All the corporate powers of the town shall be exercised
by the council or under its authority, except where otherwise pro-
vided.
Sec. 5-a. The mayor shall preside at all meetings of the council
if he be present and in his absence, any member of the council,
selected by the body for the purpose, shall be the presiding officer
pro tempore. When the mayor is the presiding officer at any meeting,
he shall vote only when there is a tie. Any member presiding pro
tempore shall vote as a member of the council but not in case of a tie.
Sec. 2l-a. All ordinances of the town must, before becoming
effective, be enacted by a majority vote of the council, and be ap-
proved by the mayor, but if disapproved by the mayor shall become
effective, only upon the affirmitive vote of the council by at least Six
(6) members thereof entered of record.
Sec. 34. His compensation shall not. exceed eleven hundred
dollars ($1,100) per annum, and all fees collected by him incident
to his office shall be paid into the treasury.
Sec. 39. His compensation shall not exceed eighteen hundred
dollars ($1,800) per annum, for all services rendered by him and
incident to his office, and all moneys received by him in fees or
other compensation, shall be accounted for by him to the town.
Sec. 44. His compensation shall not exceed fifteen hundred
dollars ($1,500) per annum.
Sec. 49. The fiscal year for the town shall be from the first day
of September to August thirty-first of the following year, and at the
first regular méeting of the council in each year, the treasurer shall
make to the council a full statement of all his transactions for the
preceeding year to September first thereof, under the regulations of
the council, which statement shall be certified by an efficient ac-
countant.
Sec. 57. An emergency existing, owing to the fact that the elec-
tion for the mayor and councilman will take place in June, nineteen
hundred and twenty, this act shall take effect from its passage.
