Chap. 50.—An ACT authorizing the payment of fees earned by certain attor-
neys for the Commonwealth. {[S B 48]

Whereas, the general assembly of nineteen hundred and sixteen
passed two laws comprised in chapter seventy-five and chapter four
hundred and ninety-six, acts of assembly of nineteen hundred and
sixteen, providing for limitation upon the fees to be paid to attor-
neys for the Commonwealth in this State, both of which went into
effect at the same time; and whereas, chapter four hundred and
ninety-six was intended to increase the allowance to the attorneys
for the Commonwealth of James City county and York county, but
not to decrease the compensations of the other attorneys for the
Commonwealth, as fixed by chapter seventy-five of the said acts:
and whereas, by inadvertence, the intended amendment was made
to chapter one hundred and ninety-nine, acts of nineteen hundred
and eight, which was not in force at that time, instead of to chap-
ter three hundred and thirty-one, acts of nineteen hundred and
twelve, which was properly used by the patron of chapter seventy-
five, acts of nineteen hundred and sixteen; and whereas, the said
chapters of the acts of nineteen hundred and sixteen are in conflict.
and the attorneys for the Commonwealth hereinafter named have
been prejudiced thereby due to the inability of the auditor of pub-
lic accounts to pay to them the amounts earned by them up to the
limitations set by chapter seventy-five. acts of nineteen hundred andl
sixteen, the law which was intended to apply in such cases as to
the compensation of the said attorneys; therefore,
1. Be it enacted by the general assembly of Virginia, That the
auditor of public accounts is hereby directed to pay out of the
appropriation to criminal charges fees earned by the attorneys for
the Commonwealth of Dickenson, Prince George, and Wise coun-
ties and the cities of Danville, Petersburg, Portsmouth and Roa-
noke, up to the limitations fixed by chapter seventy-five, acts of
nineteen hundred and sixteen, which he was prevented from paying
by the inadvertent enactment of chapter four hundred and ninety-
x, acts of nineteen hundred and sixteen, when such fees have been
lowed by the court in which the services were renderd.
2. Anemergency existing by reason of the delay in the payment
f the fees earned by the said attorneys for the Commonwealth, this
‘t shall be in effect. from its passage.
