[S B 340]
Approved March 16, 1918.
1. Be it enacted by the general assembly of Virginia, That
section two of an act entitled an act to provide for the incorpora-
tion by the court of towns of more than two hundred and less than
five thousand inhabitants, and conferring upon said towns, when
incorporated, certain powers of taxation, approved March four-
teenth, nineteen hundred and eight, be amended and re-enacted so
as to read as follows:
Sec. 2. An appeal may be granted by supreme court of appeals,
or any judge thereof, to either party from the judgment of the
court, and the appeal shall be heard and determined without refer-
ence to the principles of demurrer to evidence—the evidence to be
considered as on appeal in chancery cases, and costs in the circuit
court shall be awarded as the said court shall determine. The
costs in the supreme court of appeals shall be awarded to the party
substantially prevailing. Whenever twenty electors of such town
may petition the circuit court of the county in which the said town,
or the greater part thereof, is situated, to rescind and annul the
charter of the same, the same proceedings shall be had as to hear-
ing, publication of notice, election and appeal as were had in
pursuance of this act in relation to the incorporation of towns.
The said court may appoint a special commissioner to take evi-
dence, investigate and report as to the assets and liabilities of the
sald town, and may adjust the same in pursuance with the prin-
ciples of law and equity.
