Chap. 364.—An ACT to provide for payment of compensation to W. C. Bibb,
Commonwealth's attorney, aS counsel for the Commonwealth in the case
of Commonwealth against Geo. H. Brown, in Louisa circuit court at its
November term, 1916. (S B 239]
- Approved March 16, 1918.
Whereas, at the November term of Louisa circuit court, nine-
teen hundred and sixteen, W. C. Bibb, Commonwealth’s attorney
of Louisa county, Virginia, instituted a suit against George H.
Brown for the purpose of recovering from said Brown certain
omitted taxes on intangibles supposed to be due to the Common-
wealth; and,
Whereas, the said W. C. Bibb, as counsel for the Common-
wealth in said suit, recovered and collected from the said George H.
Brown the sum of seven thousand three hundred and eighty-one
dollars and seventy-five cents for the Commonwealth, which amount
was duly paid into the hands of the treasurer of Virginia; and,
Whereas, on application to the auditor for payment of a reason-
able amount under an act of the general assembly of Virginia,
acts of nineteen hundred and sixteen, page eight hundred and five,
as compensation for services rendered, the auditor refused to pay
anything, on the ground that the act did not cover such cases; and,
Whereas, the said W. C. Bibb entailed certain personal expense
in and about the aforesaid suit and rendered services as counsel
therein, and there is on statute under which he can be either re-
imbursed for his personal expenditures or paid a reasonable amount
for services rendered to the Commonwealth; therefore,
1. Be it enacted by the general assembly of Virginia, That
the auditor of public accounts be, and he is hereby, authorized and
directed to draw his warrant in favor of W. C. Bibb for the sum
of five hundred dollars on the treasurer of Virginia, payable out
of money in the treasury not otherwise appropriated, in full pay-
ment of the claim of said W. C. Bibb, on account of expense in-
curred and services rendered in the case of Commonwealth against
George H. Brown, formerly depending in Louisa circuit court.
