Chap. 31.—An ACT to amend and re-enact section 26 of an act entitled an
act to amend sections 16, 27, 25, 26, and 28 of the charter of Suffolk, ap-
proved February 3, 1888, (H B 62]

charter of Suffolk. approved February third, eighteen hundred and
eighty-eight, be amended and re-enacted so as to read as follows:
Section 26. The city treasurer shall give bond in such sum, not
less than fifty thousand dollars, as the council may preseribe, with
surety to be approved by the council. conditioned upon the faithful
discharge of his duties. He shall receive from the city sergeant
all fines collected by him and shall collect: and_ receive all clty
taxes, levies. dues and pecuniary demands, and for that purpose
shall be vested with any and all powers which are now or may
hereafter be vested in such city treasurer as collector of State taxes.
He shall be the custodian of all public money of the city and of all
other money coming into his hands as city treasurer. Tle shall dis-
burse the funds of the city except those to the eredit of the public
schools, which shall be disbursed as prescribed by general law, ac-
cording to the rules and regulations preseribed by ‘the council and
as the council shall have appropriated and ordered the same to be
disbursed. and not otherwise. He shall perform such other duties,
have such powers and be liable to such penalties as are now or may
hereafter be prescribed by law or ordinance.
The council shall have the power at any time, however, to ereate
the office of collector of city taxes, and, if it shall at anv time
create such office. the incumbent thereof shall be elected by the
council for such term as the couneil may determine, He = shall
vive bond in such sum, not less than fifty thousand dollars, as the
council may prescribe, with surety to be approved by the council,
conditioned upon the faithful discharge of his duties, and shall
receive such compensation as the council may from time to time
determine. Such officer shall perform the duties with reference
to the collection of city taxes. levies. fines, dues and pecuniary de-
nmands that are hereinbefore imposed upon the city treasurer, and
such other duties as may be prescribed by the council, which may
also prescribe the manner and details of the discharge of his duties.
For the collection of such city taxes, levies, fines, dues and pecuniary
demands he may exercise all the powers and shall be entitled to all
the remedies that the city treasurer now has for the collection of
the same, and shall also have and exercise all powers and remedies
the city treasurer or any State officer now has or may hereafter
have or enjoy for the collection of State taxes.
Whenever the council creates the office of collector of city taxes,
the duty and right of the city treasurer to collect city taxes, levies,
fines. dues and pecuniary demands and his compensation therefor
shall cease, and his compensation for disbursing the same shall be
such as may be prescribed by the council,
