Chap. 308.—An ACT for the relief of James R. Elam, of Danville, Va.

Whereas, at the December term, nineteen hundred and thirteen,
of the corporation court of Danville, an indictment was found
against Ada Pinnia, charging her with felonious assault; and,
Whereas, James A. Elam became surety on a bail recognizance
in the penalty of fifty dollars for the appearance of said Ada Pinnia
at the December term, nineteen hundred and thirteen, of said court,
to answer said indictment; and,
Whereas, said Ada Pinnia failed to keep her recognizance and
to appear before the corporation court of Danville for trial, as
provided therein, but absconded and became a fugitive from justice.
and thereupon at said term of court said recognizance was for-
feited; and,
Whereas at the April term, nineteen hundred and fourteen, of
said court, judgment was entered against said James R. Elam on
said forfeited recognizance for ay dollars and costs, which judg-
ment was paid by said James R. Elam on May twenty-six, nineteen
hundred and fourteen, and covered into the State treasury as per
report made by John R. Cook, clerk as of August thirty-first, nie-
teen hundred and fourteen; and,
Whereas, said James R. Elam, at his own expense, located said
Ada Pinnia, effected her arrest and delivered her into the custody
of the sergeant of said city on February twenty-seventh, nineteen
hundred and fifteen, when she was placed in jail; and,
Whereas at the March term, nineteen hundred and fifteen. of
said corporation court, said Ada Pinnia was tried by a jury, con-
victed and sentenced to thirty days in jail and fined ten dollars
and costs; and,
Whereas, there is no statute which authorizes the refund to said
James R. Elam, of Danville, Virginia, of the amount so paid by
him under said forfeited recognizance, and the clerk of the corpo-
ration court of Danville has certified that the facts above recited
are true; now, therefore;
1. Be it enacted by the general assembly of Virginia, That the
sum of fifty dollars is hereby appropriated out of any money in the
treasury not otherwise appropriated, to be paid to suid James R.
Elam, of Danville, Virginia, to re-imburse him for the amount
paid into the treasury under said forfeited recognizance.
