Chap. 235.—An ACT to amend and reenact section 2 of an act of the general
assembly of Virginia, entitled an act imposing public duties on heut,
light, power, water and telephone companies and providing for the con-
trol and regulation of such companies by the State corporation commis-
sion, which was approved March 27, 1914. [S B 185]

1. Be it enacted by the general assembly of Virginia, That sec-
tion two of an act entitled an act imposing public duties on heat,
light, power, water and telephone companies and providing for the
control and regulation of such companies by the State corporation
commission, approved March twenty-seventh, nineteen hundred and
fourteen, be amended and re-enacted so as to read as follows: —
2. Public utility defined.—The term “public utility” as used in
this act shall mean and embrace every corporation, other than a
municipality, company, individual, or association of individuals,
their lessees, trustees, or receivers, appointed by any court what-
soever, that now or. hereafter may own, operate, manage or control
any plant or equipment or any part of a plant or equipment within
the State for the conveyance of telephone messages or for the pro-
duction, transmission, delivery, or furnishing of heat, light, water,
or power, either directly or indirectly, to or for the public.
Provided the term “public utility” as herein defined, shall not
9e construed to include any hotel or corporation whose principal
ousiness is the operation of a hotel and which may supply heat,
ight, water, or power to a limited number of patrons out of its
emporary surplus.
2. All acts and parts of acts in conflict with this act are hereby
"epealed.
