Chap. 157.—An ACT to authorize the town council of the town of Waynes-
boro, to call a special election of the qualified voters of the said town,
to determine whether or nut all live stock shall be prohibited from run-
ning at large within, the corporate limits of the town of Waynesboro,
Virginia, (H B 134]

Whereas, the charter of the town of Waynesboro, in Augusta
county, as set forth in the Acts of Assembly, eighteen hundred and
ninety-five and eighteen hundred and ninety-six, in chapter five hun-
dred and ninety-seven, provides in section twelve of the said charter
that the council of said town shall have power to prohibit all ani-
mals except milk cows from running at large and beyond their
owner’s premises; and,
Whereas, by reason of the growth of said town and the increased
trafic in and upon the streets thereof, it is desirable to prohibit all
live stock from running at large in the streets and alleys of said
town of Waynesboro; therefore,
1. Be it enacted by the general assembly of Virginia, That the
town council of the said town of Waynesboro shall have power to
call an election of the qualified voters of the said town, to deter-
mine whether or not all live stock shall be prohibited from run-
ning at large on the streets and alleys of said town.
2. Such election shall be held at any time after ten days’ writ-
{en notice thereof, posted within the corporate limits of said town
at. ten prominent places.
3. The term “qualified voter” shall be construed to mean all
voters qualified to vote in the November election next succeeding
the date of the election held under this act.
4. The town council shall appoint three qualified voters of the
said town who shall act as judges for the said election, and two
qualified voters who shall act as clerks thereof, whose duties and
responsibilities shall be those prescribed by the laws of Virginia for
judges and clerks of elections.
5. The town council shall have power to pass ordinances and
provide regulations pursuant to the result of the said special election.
6. This act shall not have the effect to abrogate the authority
conferred on the town council of said town of Waynesboro to section
twelve of its charter, with regard to other live stock in the town of
Waynesboro.
7. An emergency existing this act shall be in force from its
passage.
