Chap. 94.—An ACT to create a road board for Haytokah magisterial dis-
trict of Nottoway county, and to provide for the working and repairing
of roads in such district. (S. B. 81)
Approved March 15, 1915.
1. Beit enacted by the general assembly of Virginia, That Haytokah
magisterial district in the county of Nottoway, is hereby excluded from
the operation of the system of working roads now in force in said county,
and the said district shall maintain its own road force, teams and equip-
ment.
2. There shall be established in the said district a road board to be
known as the Haytokah district road board, composed of the supervisor
of the said district and three commissioners of roads, who shall be elected
by the people at the same time as the supervisors of the county are elected ;
and shall hold office for a term of four years and shall have all the
rights, power and authority given to the superintendent of roads under
the general law of the State, but the salary of the district commissioners
shall not exceed the sum of fifty dollars per year each. All road com-
missioners appointed or elected under this act shall give a bond in the
penalty of five hundred dollars each for the faithful performance of their
duties as said road commissioners, which said bond shall be approved by
the judge of the circuit court in term time, or in vacation ; provided, how-
ever, that the first commissioners to act under this act shall be appointed
by the judge of the circuit court of Nottoway county in the term time,
and shall hold office until the first day of January, nineteen sixteen, when
their successors, who shall be elected at the regular election in November,
nineteen fifteen shall take office.
3. The county levy for road purposes assessed upon all the property
in the district shall not exceed the sum of forty cents upon the one
hundred dollars worth of property, and shall be at the disposal of the
district road board for the construction and maintenace of the roads
in the said district, except such revenue as is derived from the county
levy on the railroad property, which revenue from railroad property
shall be distributed according to the present law in such cases. The
teams, tools, and implements now belonging to the county shall be
appraised and the interest of each magisterial district therein ascer-
tained by the board of supervisors, or a commission appointed by them,
and the same, or the value thereof, prorated to the several districts
according to their appraised value and interest so ascertained; the
apportionment thus made to Haytokah district together with all sums
of money now in the treasury for road purposes in the said district
shall be placed to the credit of the said Haytokah district road board.
4. It shall be the duty of the said road board to make an estimate
of the amount of money necessary to properly work the roads in the
said district, and if it is found that the funds arising from the county
road tax is not sufficient to properly construct and maintain the roads
in the said district, then the board of supervisors shall levy a district
road tax on all the property of the district so as to increase the amount
of revenue to the estimated sum as stated by the district road board,
no part of which district road tax shall be prorated among the other
districts of the said county; which district road tax shall not exceed
the sum. of forty cents on the one hundred dollars worth of property in
the district.
5. The funds from both the county and district levies shall be
collected and held by the county treasurer subject to the draft, check
or warrant of the district road board.
6. Each check, draft or warrant issued by the district road board
upon the treasurer shall be signed by the chairman and secretary of the
said board, and shall state for what it is given, and to whom issued.
?. As soon as the said board is appointed or elected, it shall proceed
to organize by the election of a chairman and secretary.
8. Twice in each year at a time to be set by the chairman of the
board of supervisors, the said Haytokah district road board shall meet
the county treasurer at the court house and have a settlement, at which
time the board of supervisors shall examine all accounts and: vouchers
and see that the accounts of the said district road board are correct and
shall make record of the same.
9. Nothing in this act shall be construed s0 as to nullify or affect the
laws governing bond issues.
10. All acts or parts of acts in conflict with this act are hereby
repealed.
