Chap. 90.—An ACT to appropriate the sum of $100,000, or so much thereof
as may be necessary, for the prevention and eradication of the foot
and mouth disease among the live stock of this State: and to qdonfer
upon the governor, the chairman of the State live stock sanitary board
and the State veterinarian certain powers in relation thereto; and to
appropriate the further sum of $5,000, or so much thereof as may be
necessary, for the purpose of employing assistant veterinarians and
for other necessary expenses in the protection of live stock in this
State from infectious, contagious and communicable diseases: and to
require a detailed report of the expenditure of said funds. (H. B. 116)

1. Be it enacted by the general assembly of Virginia, That in order
to combat successfully the threatened ravages of the dreaded foot and
mouth disease and to stamp it out and prevent its further spread among
the live stock of this State, the sum of one hundred thousand dollars
($100,000), or so much thereof as may be necessary, be and the same is
hereby appropriated to be expended by the State live stock sanitary board,
by and with the consent and advice of the governor, in such manner and
for such purpose as they may deem necessary and proper for the eradi-
cation and control of said disease, and the protection of the State against
the further spread thereof. The said sum, or so much thereof as may
from time to time be necessary, shall be drawn from the treasury by
warrants upon the auditor of public accounts, signed by the chairman of
the said board, said warrants to be approved and countersigned by the
governor of the State. A detailed report shall be rendered to the governor
before the meeting of the next general assembly, as to the expenditure
of said appropriation.
And for the purposes hereinbefore set out, the governor and the
chairman of the State live stock sanitary board and the State veterinarian
shall have and exercise all the powers and duties now imposed by law
on the State live stock sanitary board, and they are hereby empowered
to make such rules and regulations, and from time to time to alter or
amend the same, and to establish from time to time such quarantine lines
as they may deem necessary for the eradication and control of said
disease and the protection of the State against the further spread thereof ;
and in cases of emergency the State veterinarian by and with the consent
of the governor, may temporarily suspend such rules and regulations as
to particular cases or classes of cases whenever in the opinion of the
said veterinarian and the governor public interest may so require.
2. The governor, the said chairman and the said veterinarian are
hereby authorized and empowered to cause to be killed all animals which
they may deem necessary to have killed in order to prevent the spread of
said disease, and to provide for the burial of animals so killed, and in
all cases in which such animals are killed the owner thereof shall receive
out of the appropriation hereinbefore provided for, such proportion of the
value of said animals as the said State live stock sanitary board and the
governor may deem just, and they may adopt such means as they may
see fit for ascertaining the amount of compensation to which said owner
may be entitled, but in determining said compensation they shall take
into consideration the proportion of the value of said animals paid or
to be paid by the United States government. .
3. In order to enable the State live stock sanitary board more fully
to protect the live stock of the State from infectious, contagious and
communicable diseases, and to that end to more adequately maintain the
office of the State veterinarian, including the salaries of such assistant
veterinarians as the said board may employ, together with the necessary
clerical and other expenses of the said board in performing the duties
assigned to them by law, the sum of five thousand dollars ($5,000) or
so much thereof as may be necessary, in addition to such other moneys
as have already been annually appropriated, be and is hereby appropriated
out of any moneys in the treasury not otherwise appropriated, to be paid
to the said board upon the warrant of its chairman, as now provided by
law, but a detailed statement of the expenditure of said suin shall be
submitted to the governor before the next meeting of the general assembly.
4, An emergency existing because of the presence of foot and mouth
disease in this State, and because of imminent danger of further infec-
tion, this act shall be in force from its passage.
