Chap. 34.— An ACT to authorize and empower George N. Wise and Sterling
Nottingham, their associates, successors and assigns, to build, construct,
maintain and operate a toll bridge or private bridge across and over the
northwest prong. of Back river, some times known as Wythe creek, lying
between the counties of York and Elizabeth City, Virginia, under certain
conditions. (S. B. 41)

1. Be it enacted by the general assembly of Virginia, That George
N. Wise, of Newport News, Virginia, and Sterling Nottingham, of North-
ampton county, Virginia, their associates, successors and assigns, be, and
they are, hereby authorized and empowered in so far as the general as-
sembly of Virginia has the power to confer such power and authority
to build, construct, maintain and operate a toll bridge or private bridge,
as to them may seem best, over and across the northwest branch of Back
river, sometimes known as Wythe creek, between the counties of York
and Elizabeth City, Virginia; provided, however, that the same is lo-
cated above the present iron bridge across the said creek or river; and
provided, however, that the said persons, their associates, successors, or
assigns, herein named, shall indemnify and save harmless the Common-
wealth of Virginia from any and all loss and damage that may be sus-
tained by any person by reason of the power and authority hereby con-
ferred.
2. That the persons herein named, their associates, successors, or as-
signs, shall comply with the provisions of the act of congress for such
cases made and provided.
8. That the amount of tolls to be charged and the collections and
regulations thereof shall be subject to all the provisions of chapter sixty-
two of the Code of Virginia, and the acts heretofore passed, amendatory
thereto, in so far as said chapter and said acts are applicable thereto.
4. In the event that the said bridge shall be made a toll bridge, the
said parties herein mentioned, their associates, successors and assigns
shall have the right to make the said bridge free, or to use the said bridge
as a private bridge, as to them shall seem best; and the said parties herein
mentioned, their associates, successors, and assigns shall have the right
to transfer the privilege herein conferred, by deed.
