Chap. 70.—An ACT to amend and re-enact an act approved May 16, 1887,
entitled an act to amend and re-enact an act entitled an act to release
and transfer to the counties of Highland and Augusta the interest of
the Commonwealth in the Staunton and Parkersburg turnpike road,
et cetera. (H. B. 188.)

1. Be it enacted by the general assembly of Virginia, That
sections one, and sub-section three and section eight of the acts of
eighteen hundred and eighty-seven, approved May sixteenth, eigh-
teen hundred and eighty-seven, be amended and re-enacted so as to
read as follows:
Sec. 1. That all interest of the Commonwealth in that portion
of the Staunton and Parkersburg turnpike road, lying between the
Augusta line on the top of the Shenandoah mountain to the West
Virginia line, be, and is hereby, released to the county of Highland,
and said county is hereby vested with all the powers heretofore
vested in the Commonwealth or board of public works, relative to
said road.
8. Sub-section 3. That portion of said road lying in the county
of Augusta, between the city of Staunton and the line between
Highland and Augusta counties on the top of the Shenandoah
rnountain, is hereby turned over to said county of Augusta to be
worked and operated under the road laws of that county; provided,
further, that the board of supervisors of Augusta shall have the
right to establish and maintain a toll gate at the forks of the road
at West Augusta, and to fix the rate of tolls in accordance with the
road laws of Augusta county, said tolls to be used for the main-
tenance and upkeep of said road to the Highland county line.
2. There being an emergency by reason of the need of properly
working the roads of said county, this act shall be in force from its
passage.
3. All acts or parts of acts in conflict with this act are hereby
repealed.
