Chap. 39.—An ACT to amend and re-enact sections 2, 3, and 4 of an act ap-
proved February 8, 1908, entitled an act to amend and re-enact an act
approved March 7, 1906, entitled an act to amend an act approved
March 10, 1904, entitled an act to amend and re-enact an act approved
April 2, 1902, entitled an act to amend and re-enact an act entitled an
act to provide a road law for Campbell county, approved March 5, 1900,
providing and regulating a road board for said county, and directing tha
disbursement of the county road fund. (CS. B. 193.)

1. Be it enacted by the general assembly of Virginia, That
sections two, three and four of an act approved February eighth,
nineteen hundred and eight, entitled an act to amend and re-enact
an act approved March seventh, nineteen hundred and six, entitled
an act to amend and re-enact an act approved March tenth, nine-
teen hundred and four, entitled an act to amend and re-enact an
act approved April second, nineteen hundred and two, entitled an
act to amend and re-enact an act entitled an act to provide a road
law for Campbell county, approved March fifth, nineteen hundred,
providing and regulating a road board for said county, and direct-
ing the disbursement of the county road fund, be amended and re-
enacted so as to read as follows: ; ;
Beginning with the election to take place in the fall of nineteen
hundred and fifteen, said commissioner and clerk shall be elected
by the qualified voters of the district at the same time members of
the house of delegates are elected, and shall hold office for a term
of four years, beginning on the first day of January next succeeding
their election. They shall reside in the district for which they are
elected or appointed.
Bach eammissioner of roads and each clerk of a road board thus
. pointed or elected shall qualify before the circuit court, and shall,
the time of qualification, give bond, with good security, in the
‘ tnalty of not less than one thousand dollars.
1- 3. The said commissioner of roads shall receive such compensa-
k ion for his services as the board of supervisors shall allow, not to
exceed two ($2.00) dollars per day, and not to exceed sixty dollars
ir.oer annum; the clerk of the road board shall receive for his ser-
h. vices thirty dollars per annum, and the chairman of the road board
b- sliall receive for his services two dollars per day for not exceeding
r eighteen days, to be paid at such times and in such amounts, by
| varrants drawn by said board of supervisors on the treasury of said
r- :ounty, as said road board may, by its order entered on its minutes,
y determine. Any vacancy in the office of commissioner or clerk of
the road board shall be filled for the unexpired term by the circuit
t court. The said commissioner and clerk of the road board, before
entering upon the duties of their offices, shall severally take oath to
Yaithfully perform the duties of their offices, which oath shall be
filed by the clerk of said circuit court.
4. Each road board shall, as soon as practicable after their
4 qualification, carefully examine all the public roads and _ public
4 sewers of their district and if they shall deem best for the more
¢ convenient working or maintenance of same, lay off and divide them
# into sections of from one to five miles, no single section to be more
' than five miles in length; and, said road board shall have power to
, extend any such public sewer and to lay and construct, or cause
to be laid and constructed, new and additional sewers whenever said
road board deems it necessary or proper in order to protect the health
of the public in any locality, or to properly drain the public roads,
i or to dispose of the drainage therefrom. Such sewers shall be con-
ut structed or extended and maintained with or without private finan-
i cial aid as the road board shall deem proper and the owners of
‘« adjacent houses, closets and property shall have the right to tap,
i and connect their premises with such sewers on such terms as said
« yoad board shall prescribe; provided, however, that nothing herein
< contained shall be construed as taking away from the board of
i+ Supervisors of the right to construct and maintain sewers, but on
i the contrary the board of supervisors shall have power to lay, con-
re struct and maintain sewers or to contribute to the laying, construc-
® tion and maintenance of sewers by said road board or any private
citizens whenever found necessary or proper to protect the public
w health or properly drain the public roads or dispose of the drainage
at therefrom.
