Chap. 282.—An ACT to amend and re-enact section 3530 of the Code of Vir-
ginia, as amended and re-enacted by an act approved February 26, 1894,
as amended and re-enacted by an act approved March 14, 1908, relative
to the fees of justices in criminal cases, payable out of the treasury of
the Commonwealth. (H. B. 390.)

1. Be it enacted by the general assembly of Virginia, That
ection thirty-five hundred and thirty of the Code of Virginia, as
.mended and re-enacted by an act approved February twenty-sixth,
-ighteen hundred and ninety-four, and as amended and re-enacted
y an act approved March fourteenth, nineteen hundred and eight,
-elative to the fees of justices in criminal cases, payable out of the
“seasury of the Commonwealth, be amended and re-enacted sv as
‘read as follows:
Sec. 3530. To a justice——For issuing warrant of arrest, fifty
mts; for trying or examining a case of misdemeanor, fifty cents;
w examining a charge of felony, one dollar.
The said fees shall be in full for all services rendered in each
ise by a justice, but shall not be allowed or paid by the auditor
of public accounts without a certificate of the judge of the court. al-
lowing the account that he has actually examined the papers upon
which the account is founded and is satisfied that the warrant was
issued and trial had or examination made; provided, that the police
justice of a city shall not be entitled to receive out of the State
treasury the fees provided in this section, but every police justice
shall be paid by the city for which he is police justice, except that
in cities having a population of over sixty thousand and under one
hundred thousand inhabitants, shall be allowed a salary of twenty-
five hundred dollars per annum payable out of the State treasury.
2. Because this act affects payments out of the State treasury,
un emergency exists; therefore it shall be in force from its passage.
