1. Be it enacted by the general-assembly of Virginia, That
section thirty-six hundred and sixty-three, be amended and re-
enacted so as to read as follows:

Sec. 3663. Murder of the first degree shall be punished with
death, or in the discretion of the jury by confinement in the peni-
tentiary for life.
