Chap. 226.—An ACT for the relief of M. F. Swann, treasurer of Powhatan
county. (H. B. 457.)

Whereas, M. F. Swann, treasurer of Powhatan county, purchased
in the name of the auditor for delinquent taxes thereon the follow-
ing.tracts of land in the following years, upon which the said M. F.
Swann was entitled to be allowed as a credit upon his settlement
with the auditor a fee of twenty-five cents for each tract purchased,
and a clerk fee of five cents for each tract purchased as follows: In
the year eighteen hundred and ninety-nine, on the purchase of fifty-
nine tracts; in the year nineteen hundred on the purchase of eighty-
five tracts; and in the year nineteen hundred and one on the pur-
chase of sixty-eight tracts; and,
Whereas, in the said three years there were the total of two
hundred and twelve tracts purchased by the said M. F. Swann,
treasurer, upon which he was entitled to the sum of fifty-three
dollars as his fee, and the additional sum of ten dollars and sixty
cents as his clerk’s fees; and,
Whereas, the auditor of public accounts failed to give the said
M. F. Swann, treasurer, credit by the above amounts in his settle-
ments for the said years or at any time since, and whereas the said
M. F. Swann, just discovered this mistake in the year nineteen hun-
dred and thirteen; and,
Whereas, the said auditor can not allow the said fees to M. F.
Swann, as provided for in section six sixty-nine of the Code of Vir-
ginia, without a special act of the general assembly; therefore,
1. Be it enacted by the general assembly of Virginia, That
the said M. F. Swann be, and he is hereby, allowed the sums of fifty-
three dollars for his said fees, and the sum of ten dollars and sixty
cents for his said clerk’s fees, payable out of the treasury, and the
auditor of public accounts is hereby directed to draw his warrants
for the respective sums of fifty-three dollars and ten dollars and
sixty cents upon the treasurer payable to the order of M. F. Swann.
