Chap. 218.—An ACT to amend the charter of the town of The Plains, in
Fauquier county, Virginia, granted by the circuit court of Fauquier county
by an order entered on the 26th day of April, 1910, pursuant to an act of
the general assembly of Virginia, approved March 14, 1908, entitled an
act to provide for the incorporation by the courts of towns of more than
200 and less than 5,000 inhabitants, and conferring upon said towns,
when incorporated, certain powers of taxation. (H. B. 207.)

Whereas, pursuant to an act of the general assembly, approved
March fourteenth, nineteen hundred and eight, entitled an act to
provide for the incorporation by the courts of towns of more than
two hundred and less than five thousand inhabitants, and conferring
upon said towns, when incorporated, certain powers of taxation, the
circuit court of the county of Fauquier by its order duly entered
in the records of the said court on the twenty-sixth day of April,
nineteen hundred and ten, declare “the town of The Plains,” in said
county of Fauquier a body politic and corporate, with all the powers,
privileges and duties conferred upon and appertaining to towns
under the general laws of the State of Virginia; and,
Whereas, the act aforesaid provided no method for amending the
charters of towns granted thereunder, and it is desired by the coun-
cil of the town of The Plains, as well as by the inhabitants of said
town, that all taxable property within the corporate limits of said
town shall be exempt from all levies by the county authorities for
the construction, repair, or maintenance of roads outside of said
town; now, therefore,
1. Be it enacted by the general assembly of Virginia, That
the charter of the town of The Plains, as set forth in the order
aforesaid of the circuit court of Fauquier county on the twenty-
sixth day of April, nineteen hundred and ten, and the general laws
of the State of Virginia in relation to the powers, privileges and
duties of incorporated towns, so far as the same may be applicable
thereto.
(1) The town of The Plains in Fauquier county, its inhabitants
;and all taxable property within the corporate limits of said town
« Shall be exempt from all assessments or levies in the way of taxes
: imposed by the authorities of Fauquier county for the construction,
repair, or maintenance of roads lying outside of said town; pro-
, vided, however, that all such taxable property within the corpora-
, tion limits of said town shall not be exempt from any special levy
, Gf taxes made by said authorities of Fauquier county for the pur-
- pose of creating a sinking fund to redeem the principal of, or of
>, paying the interest on any bonds of said county of Fauquier issued
for the purpose of macadamizing or otherwise permanently im-
, proving the public roads or bridges either of the said county, or
‘of the magisterial district in which said town is located, pursuant to
any special election fcr either of such purposes as now provided
by law; but in the event of any such special election for the purpose
: of authorizing the issuance of bonds to build roads or bridges
:s either in the county, or in the district in which said town is located,
the qualified voters of said town shall have the right to vote at any
‘such election.
_ 2. All acts or parts of acts in conflict with this act are hereby
“: repealed.
