Chap. 203.—An ACT to amend and re-enact an act approved March 138, 1912,
entitled an act to authorize the board of supervisors of Rockingham
county, in the State of Virginia, to establish toll gates for the purpose
of maintaining the macadam roads in said county. (H. B. 219.)

1. Be it enacted by the general assembly of Virginia, That
an act approved March thirteenth, nineteen hundred and twelve,
entitled an act to authorize the board of supervisors of Rocking-
ham county, in the State of Virginia, to establish toll gates for
the purpose of maintaining the macadam roads in said county, be
amended and re-enacted as follows:
Sec. 1. Be it enacted by the general assembly of Virginia,
That the board of supervisors of Rockingham county, in the State
of Virginia, shall be empowered to erect and maintain toll gates
if, in their discretion, they deem it proper to do so, and to demand
and collect tolls on all the macadamized roads in said county,
except those hereinafter exempted, the rate of toll to be fixed by
the said board of supervisors; provided, however, that the said
rates shall not exceed those fixed by the general laws for turnpikes.
Sec. 2. That the road boards of the respective magisterial
districts shall have exclusive charge and control of all the macad-
amized roads, and shall be charged with the duty of collecting and
disbursing all tolls collected from said roads in the said respective
districts.
Sec. 3. That there shall be but one toll gate to every five
miles, or fraction thereof, and on such fraction the rate charged
shall be pro rata to the five mile rate.
Sec. 4. That all the tolls collected from any one of such
macadamized roads shall be expended in maintaining the road
from which said tolls were collected.
Sec. 5. That the board of supervisors of said county shall
have the power, if they deem it wise and proper to exercise the
same, to give a rebate in tolls to those who have made, or shall
hereafter make, private subscriptions to the building of permanent
macadam roads in said county on any road where toll gates shall
be established, and said rebates shall be in such amounts as the
board of supervisors shall determine, but not to exceed in any
case the amount of said private subscriptions.
Sec. 6. That all road boards of the respective districts of said
county shall make, on the first day of January of each year, an
itemized report to the board of supervisors of said county, of all
the collections and disbursements of the funds that shall come
under their jurisdiction, by virtue of their office. The said board
of supervisors shall record, or cause to be recorded, in a book kept
for that purpose, all such reports, and said book shall be filed in
the circuit clerk’s office of said county, and shall be open to
inspection by any person desiring to examine such records.
_. Sec. 7. That on all macadam roads on which toll is collected.
if the reports show more money than is strictly necessary for th:
maintenance or up-keep of the road on which it is collected, the
toll on that road shall be rebated pro rata to such surplus
Sec. 8. That all persons who may desire to pay their toll in
advance for one year. on any of the macadam roads, shall have
that privilege by paving a reasonable amount, fixed by the road
board of the district in which the road is located, and based or
distance, kind. and frequency of travel.
Sec. 9. That on petition of one-fourth of the qualified voter
of the county. or any one of the respective districts thereof, the
board of sunervisors shall call and provide for a special election
on the question of toll or no toll, and if the majority of the people
vote for no toll. then the toll gates shall be abolished in the countr
or district, as the case may be. ,
Sec. 10. That the provisions of this bill shall not apply to
those macadam roads in said county which have been or are being
built under the provisions of other special laws.
Sec. 11. That all acts, or parts of acts, inconsistent with
this act shall be repealed.
