Chap. 182.—An ACT to repeal an act entitled an act to transfer to the
county of Frederick the State’s interest in so much of the Northwestern
turnpike company as lies within the county of Frederick, approved Feb-
ruary 26, 1884; and to authorize the board of supervisors of the county
of Frederick to transfer the said interest to the State corporation com-
mission, (H. B. 474.)

1. Be it enacted by the general assembly of Virginia, That
Whereas, under authority of an act of the general assembly of
Virginia. entitled an act to provide for the construction of a turn-
pike road from Winchester to some point on the Ohio river, passed
March nineteenth, ‘eighteen hundred and thirty-one, a turnpike
road was constructed by the State of Virginia from Winchester
to the Ohio river; and,
Whereas, now by reason of the partition of the Commonwealth
of Virginia only about seventeen miles of said road remain within
the limits of the State of Virginia, and this section of said road
lies altogether within the county of Frederick; and,
Whereas, by an act of the general assembly entitled an act to
transfer to the county of Frederick the State’s interest in so much
of the northwestern turnpike as lies within the county of Frederick,
approved February twenty-sixth, eighteen hundred and eighty-four,
the management and control of said section of the road was trans-
ferred to the board of supervisors of Frederick county, to the relief
of the board of public works of Virginia that the management and
control of such section of said road should be transferred to the
State corporation commission;
1. Be it enacted by the general assembly of Virginia, That
all the right, title and interest of the State of Virginia in and to the
northwestern turnpike road, or so much thereof as lies within the
State of Virginia, together with all the bridges and other property
belonging or appertaining thereto, be, and the same are, hereby
transferred to the State corporation commission of Virginia.
2. That it shall be the duty of said corporation commission to
take charge of so much of said road as lies within the said county,
and cause the same to be put and kept in repair under the superin-
tendence of the State highway commissioner. The corporation com-
mission shall forthwith appoint such other officers and agents as
may be needed for the efficient operation of said road, and may
remove the same from time to time as to the said corporation com-
mision may seem proper. It shall cause the tolls to be faithfully
collected within the limits prescribed by law, and regularly applied
to the maintenance and improvement of the said road; and a sum
is hereby annually appropriated out of the public treasury for the
maintenance and improvement of said road equal to the amount of
tolls annually collected.
In addition to the powers which the corporation commission
has over corporations in which the State of Virginia owns an in-
terest, it shall exercise all the corporate powers of said northwestern
turnpike company, and shall have all the rights and powers of, and
perform all the duties which devolve upon, the board of public
works with respect to said road prior to the passage of said act of
general assembly, approved February twenty-sixth, eighteen hun-
dred and eighty-four.
3. That the said act entitled an act to transfer to the county of
Frederick the State’s interest in so much of the northwestern turn-
pike company as lies within the county of Frederick, approved
February twenty-sixth, eighteen hundred and eighty-four, be, and
the same is, hereby repealed.
