Chap. 36.—An ACT to authorize the school board of Western Branch
magisterial district, No. 1, of the county of Norfolk, to borrow $81,-
600.00 for the purpose of refunding bonds issued by authority of Acts
of the General Assembly, approved February 16, 1901; March 8, 1906;
February &, 1908; March 12, 1908, and March 4, 1910, and also an
additional $20,000.00 for the purpose of school improvements in said
district. and to issue bonds therefor not exceeding $101,600.00 in
amount. :

Whereas, by an act of the general assembly of Virginia en-
titled an act to allow Western Branch school district, number one,
of Norfolk county, to borrow money and issue bonds therefor,
approved February the sixteenth, nineteen hundred and one,
the school board of Western Branch district, number one, of the
county of Norfolk, was by the body of said act authorized and
empowered to borrow money not exceeding fifteen thousand (15,-
000) dollars in amount, the same to be used for acquiring lands
for public free school purposes, and the construction and equip-
ment of suitable and sufficient school buildings thereon in West-
ern Branch district, in said county; and
Whereas, the school board of Western Branch district, num-
ber one, of the county of Norfolk, under the above mentioned act
of February the sixteenth, nineteen hundred and one, issued its
authorized by said act and in conformity with its provisions; and
Whereas, by an act of the general assembly of Virginia, en-
titled an act to authorize the school board of Western Branck
magisterial district, number six, of the county of Norfolk, tc
borrow money for the purpose of school improvements in said
district, and to issue bonds therefor, not exceeding fifty thousand
($50,000) dollars in amount, approved March the eighth, nine-
teen hundred and six, the school board of Western Branch dis-
trict, number one, of the county of Norfolk, was by the body
of said act, authorized and empowered to borrow money not
exceeding fifty thousand ($50,000) dollars in amount, the same
to be used for school improvements in said district; and
Whereas, the school board of Western Branch district, num-
ber one, of the county of Norfolk, under the above mentioned act
of March the eighth, nineteen hundred and six, issued its bonds
to the amount of fifty thousand ($50,000) dollars, as authorized
by said act and in conformity with its provisions; and
Whereas, by an act of the general assembly of Virginia, ap-
proved February the eighth, nineteen hundred and eight, and
entitled an act to validate and confirm certain bonds issued by
the school board of Western Branch magisterial district, number
one, of the county of Norfolk, under an act entitled an act to
authorize the school board of Western Branch magisterial dis-
trict, number six, of the county of Norfolk, to borrow money for
the purpose of school improvements in said district, and to issue
bonds therefor not exceeding fifty thousand dollars in amount,
approved March eighth, nineteen hundred and six; and to au-
thorize the board of supervisors of Norfolk county to guarantee
the payment of said bonds; and
Whereas, by an act of the general assembly of Virginia, ap-
proved March the twelfth, nineteen hundred and eight, and en-
titled an act to amend and re-enact an act entitled an act to
validate and confirm certain bonds issued by the school board
of Western Branch magisterial district, number one, of the
county of Norfolk, under an act entitled an act to authorize the
school board of Western Branch magisterial! district, number six,
of the county of Norfolk, to borrow money for the purpose of
school improvements in said district, and to issue bonds therefor,
not exceeding fifty thousand dollars in amount, approved March
eighth, nineteen hundred and six, and to authorize the board of
supervisors of Norfolk county to guarantee the payment of said
bonds, as amended and re-enacted by an act approved February
the eighth, nineteen hundred and eight; and
Whereas, by an act of the general assembly of Virginia, en-
titled an act to authorize the school board of Western Branch
magisterial district, number one, of the county of Norfolk, to
borrow money for the purpose of school improvements in said
district, and to issue bonds therefor, not exceeding fifty thousand
($50,000) dollars in amount, approved March the fourth, nine-
teen hundred and ten, the school board of Western Branch dis-
trict, number one, of the county of Norfolk, was, by the body of
said act, authorized and empowered to borrow money not exceed-
ing fifty thousand ($50,000) dollars in amount, and the same to
be used for school improvements in said district; and
Whereas, the school board of Western Branch district, num-
ber one, of Norfolk county, under the above mentioned act of
March the fourth, nineteen hundred and ten, issued its bonds to
the amount of fifty thousand ($50,000) dollars, as authorized by
sald act and in conformity with its provisions; and
Whereas, certain territory in Western Branch district was
annexed to the city of Portsmouth, March the twenty-second,
nineteen hundred and nine, and the circuit court of Norfolk
county, in its order of annexation, allowed Western Branch mag-
isterial district, number one, of the county of Norfolk, thirty-
three thousand and four hundred ($33,400) dollars as payment
for the school property in said annexed territory, and in its de-
cree further ordered that the city of Portsmouth should assume
thirty-three thousand and four hundred ($33,400) dollars of the
school bonds that had been issued by said Western Branch dis-
trict, number one, of the county of Norfolk; therefore
1. Be it enacted by the general assembly of Virginia, That
the school board of Western Branch district, number one, of
the county of Norfolk, be authorized and empowered to borrow
money not to exceed the sum of one hundred and one thousand
and six hundred ($101,600) dollars, eighty-one thousand and six
hundred ($81,600) dollars of this amount to be used for refund-
ing the bonds that were issued under acts approved February
the sixteenth, nineteen hundred and one, March the eighth, nine-
teen hundred and six, February the eighth, nineteen hundred and
eight, March the twelfth, nineteen hundred and eight, and March
the fourth, nineteen hundred and ten, with the exception of the
thirty-three thousand and four hundred ($33,400) dollars
assumed by the city of Portsmouth as per the order of the cir-
cuit court of Norfolk county, and the remaining twenty thousand
($20,000) dollars of this one hundred and one thousand and six
hundred ($101,600) dollars to be issued and used for school im-
provements in said district.
2. That the said school board may issue bonds not to exceed
the said sum of one hundred and one thousand and six hun-
dred ($101,600) dollars, the said bonds to be in denominations
of five hundred and one thousand dollars, to bear interest not
to exceed five per centum per annum, payable semi-annually,
with interest coupons attached thereto, and the principal thereof
to be paid twenty years after the date thereof, and to be a lien
upon all the school property of said school district number one,
of the county of Norfolk: the said s chool property, shall be
pledged for the payment of the principal and interest thereof,
according to their tenor and date, and the said bonds shall be
in the form following:
Know all men by these presents, That the school board of
Western Branch district, number one, of the county of Norfolk,
in the state of Virginia, is justly indebted to.............. or
bearer in the sum of...........-2cceeeecees dollars, and bear-
ing interest at the rate of five per centum per annum, from date,
payable semi-annually, on surrender of the proper coupons hereto
attached, until payment of the principal sum. In testimony
whereof the said school board of Western Branch district, num-
ber one, of the county of Norfolk, has caused the corporate seal
of the same to be affixed, and these presents to be signed by
its chairman and attested by its clerk, this............... day

3. That in making sale of the said bonds that shall be issued
in accordance with the provisions of this act at no time shall
the said bonds be sold for less than their par value. And the
said school board shall provide for the payment of the accruing
interest, and also for the principal of said bonds, in such man-
ner and by such means as it shall deem necessary.
4. That eighty-one thousand and six hundred ($81,600) dol-
lars of said bonds may be issued by the said school board for the
purpose of refunding a like amount of bonds heretofore issued
under the acts of the general assembly, hereinbefore set out, and
that the remaining twenty thousand ($20,000) dollars of said
bonds may be issued by the said school board only for the pur-
poses hereinbefore set out.
5. The necessity of raising money for the purposes of school
improvements in this district creates an emergency, and this act
shall be in force from its passage.
