CHAP. 135.—An ACT to amend an act approved January 25, 1898, entitled
an act to provide for the opening and working of roads and keeping
the same in repair and to provide for erecting and maintaining bridges
in the county of Culpeper, as amended and re-enacted by an act ap-
proved March 14, 1906, and as further amended by an act approved
February 21, 1908, so as to add a new section thereto to be known as
section 151-2 providing for an election in said county on the question
of borrowing money and issuing bonds therefor for improving the
roads in Catalpa magisterial distviet in svzh eounty, including the
town of Culpeper, and defining the effect thereof.

Be it enacted by the general assembly of Virginia, That an
act approved January 25, 1898, entitled an act to provide for the
opening and working of roads and keeping the same in repair
and to provide for erecting and maintaining bridges in the
county of Culpeper, as amended end re-enacted by an act ap-
proved March 14, 1906, and as further amended by an act ep-
proved February 21, 1908, so as to add a new section thereto to
be known as section 1514, providing for an election in said county
on the question of borrowing money and issuing bonds therefor
for improving the roads in Catalpa magisterial district in such
county, including the town of Culpeper, and defining the effect
thereof, be amended and re-enacted so as to read as follows:
$1514. The circuit court of Culpeper county, upon the peti-
tion of the board of supervisors of said county and of fifty
freeholders of the said county, and the petition of the council
of the town of Culpeper, or of fifty freeholders of the said
town, shall make an order requiring the judges of election, at
the next election of county officers or at any other time not less
than thirty days from the date of such order, which shall be
designated therein, to open a poll and take the sense of the quali-
fied voters of the county on the question, whether the board of
supervisors shall issue bonds for the purpose of macadamizing
or otherwise improving the public roads and bridges of Catalpa
magisterial district, in said county, or either of said purposes;
the approximate location, length and width of such roads as are
proposed to be macadamized or permanently improved, to be
named in the order of said court.
The order shall designate the maximum amount of such
bonds to be issued, which shall in no case exceed an amount in
excess of ten per centum of the total taxable values at the time,
of catalpa magisterial district, including the town of Culpeper.
Any election held under this act shall be conducted, the re-
turns made and canvassed, bonds issued, negotiated and paid,
and the macadamizing, or other permanent improvement done
on the said roads and streets, as provided for by an act entitled
an act to provide for the issuing of county bonds for permanent
road or bridge improvement in the magisterial districts of the
counties of the State, approved February twenty-five, nineteen
hundred and eight, and as amended and re-enacted by an act
approved February sixteen, nineteen hundred and ten.
For the purposes of this act, and for no other purpose what-
ever, the term “roads and bridges of Catalpa magisterial dis-
trict” shall be construed to embrace the public streets and
bridges of the town of Culpeper, and to provide for paying the
principal and interest on said bonds, the taxable values in the
town of Culpeper shall be taxed by the board of supervisors of
said county at the same rate that the taxable values of said dis-
trict shall be taxed for that purpose.
2. It being desired to hold an election in Catalpa magisterial
district on the question of issuing bonds at an early date, an
emergency is declared to exist, and this act shall take effect from
its passage.
