CHAP. 128.—An ACT to reimburse W. C. Parks and others, district road
commissioners for Washington county, for advancing certain funds
for local public road improvements on account of a deficiency in the
State convict road force fund.
Approved March 11, 1912.
Whereas, the local road authorities of Washington county
undertook to improve permanently certain roads in the Holston
magisterial district and availed themselves of the use of the
State convict road force; and,
Whereas, after said public road improvements were begun
and the convict road force was at work in said Holston magis-
terial district, it was ascertained that the State convict road
force fund was not sufficient to maintain said force of convicts
at work in said magisterial district; and, .
Whereas, W. C. Parks, W. R. Preston and C. K. Wright,
the district road commissioners of Holston magisterial district,
Washington county, Virginia, in order to carry on certain public
road improvements, did advance, for the maintenance of the said
convict road force, funds on their own personal responsibility to
the extent of ten thousand four hundred and eighty-eight dollars
and seventy-five cents, and,
Whereas, it was represented to them that a recommendation
would be made to the general assembly of Virginia to pass an
enabling act to reimburse said district road authorities for such
Sum so advanced; and,
Whereas, the said sum of ten thousand four hundred and
eighty-eight dollars and seventy-five cents was necessary to carry
on said public road improvements, and was advanced by said
district road commissioners between the first day of June, nine-
teen hundred and ten, and the first day of October, nineteen hun-
dred and eleven, at which last named period the State convict
road force fund was sufficient to take care of the maintenance of
said convicts; now, therefore,
1. Be it enacted by the general assembly of Virginia, That
the sum of ten thousand four hundred and eighty-eight dollars
and seventy-five cents, or so much thereof as may be necessary,
is hereby appropriated out of money not otherwise appropriated,
to be paid upon the order of W. C. Parks, W. R. Preston and
C. K. Wright, district road commissioners of Holton magisterial
district for Washington county, for the purpose of reimbursing
them for funds advanced on account of the deficiency in State
convict road force fund.
The said district road commissioners shall itemize their ac-
count making said sum of ten thousand four hundred and eighty-
eight dollars and seventy-five cents, and verify the same by their
oaths; and if said account shall be approved by the State high-
way commissioner, and, when so verified and approved, when
presented to the auditor of public accounts, he shall draw his
warrant upon the treasurer for the amount called for by said
account payable to said district road commissioners, and it shall
be the duty of the treasurer to pay such warrant out of the
fund appropriated by this act.
2. An emergency existing therefor, this act shall take effect
from its passage.
