Chap. 125.—An ACT to amend and re-enact section three of an act to
incorporate the town of Elba, Pittsylvania county, approved February
2, 1901, as amended by an act approved February 16, 1901.

Whereas, a vacancy exists in the office of mayor of the town
of Elba, Pittsylvania county, and vacancies in the council of said
town by death and removal, whereby said council is left with-
out a quorum, now, therefore,
1. Be it enacted by the general assembly of Virginia, That
section three of an act entitled an act to incorporate the town
of Elba, Pittsylvania county, approved February the second,
nineteen hundred and one, as amended by an act approved Feb-
ruary the sixteenth, nineteen hundred and one, be dmended and
re-enacted so as to read as follows:
§3. The government of said town shall be vested in a
mayor and six councilmen, and such other officers as may be
provided for by the mayor and council. J. S. Adams is hereby
appointed mayor thereof, and John E. Bennett, Stover H. Crea-
sy, Oscar L. Ramsey, James H. Moon, B. R. Powell, and H. M.
Acuff are hereby appointed councilmen thereof. The council-
men shall serve without pay, and the said mayor and council-
men shall have and exercise all the powers hereinafter granted
to said officers, and shall continue in office until their succes-
sors shall be elected and qualified according to law. <A majority
of said council shall constitute a quorum for the transaction of
business. The mayor and councilmen shall constitute the town
council.
2. An emergency existing by reason of the vacancies afore-
said, this act shall be in force from its passage.
