CHAP. 116.—An ACT to preszrite a fence law for Fork Magisterial Dis-
trict of Warren county.
Approved March 11, 1912.
1. Re it enacted by the general assembly of Virginia, That
the boundary lines, except those hereinafter specified, of each
tract or lot of land and the lines pounding the limits of each
public road, within the limits of Fork magisterial district of
Warren county, shall be deemed and are hereby constituted law-
ful fences; provided, that this act shall not extend to any divis-
ion line between actually enclosed or cultivated lands, nor re-
lieve any railway company from its obligation to fence its lim-
its under the general State laws.
2. A lawful fence along a division line between actually en
closed or cultivated lands shall be a fence four and one-hal:
feet high, including the base or mound upon which said fence
rests, if any there be, and sufficiently tight and strong to pre
vent the passage of stock without breaking or displacing the
same, and the owner of land on either side of such division line
if he desires to build or repair said fence, shall have all the
rights and remedies now afforded by the general laws of thi:
State.
3. Before this act shall go into effect, however, the cir
cuit court of Warren county, or the judge thereof in vacatio1
shall, upon the petition of thirty qualified voters of said For]
magisterial] district, submit its adoption or rejection to th
qualified voters of said district.
