CHAP. 110.—An ACT to provide for the sale of estates of freehold in land,
and such estates in personal property as would be estates of freehold,
if they were estates in land, taken by deed, will or other writings, to
any person, with limitation therein, by way of remainder to his “heirs,”
or “heirs of his body,” or ‘‘issue,” or other words of like import, and
the investment of the proceeds of such sales for the use and benefit of
the person so holding the estate, subject to such limitation.

1. Be it enacted by the general assembly of Virginia, That
where any estate of freehold in land, or such an estate in per-
sonal property, as would be an estate of freehold, if it were
an estate in land, has been, or shall hereafter be, taken by deed,
will or other writing, to any person, and in the same deed, will
or other writing, an estate is afterwards limited by way of
remainder, either mediately or immediately, to his “heirs,” or
“the heirs of his body,” or ‘“‘issue,’”’ or other words of like im-
port used in the deed, will, or writing, in the limitation therein
by way of remainder, it shall be lawful for the circuit or cor-
poration courts, upon a bill filed by the person holding the
estate subject to such limitation, in which bill all persons who
would be his “‘ heirs” or “‘heirs of his body,” if he were dead, or
who are his “‘issue,’”’ or other words of like import, shall be
made defendants, to decree a sale of such estate, real or per-
sonal, and to invest the proceeds of such sale, under the decree
of the court, for the use and benefit of the person so holding
the estate, subject to the limitations of the deed, will or other
writing creating the estate; provided, however, that the bill
of the plaintiff shall set forth the facts which, in his opinion,
would justify the sale of the said estate, to be verified by the
afidavit of the party; and provided further, that sections twen-
ty-four hundred and thirty-three, twenty-four hundred and thir-
ty-four, twenty-four hundred and thirty-five and twenty-four
hundred and thirty-six of the Code of Virginia shall apply to
the proceedings upon such bill.
