Chap. 58.—An ACT to provide for the payment out of the State treasury.of the
sum of $66,604.56 for the completion of certain buildings of the State peniten-
tiary provided for by an act approved April 2, 1902, said sum being. the balance
of the appropriation of $180,000 made by the said act.

Whereas, an act approved April second, nineteen hundred and. two;
providing for the erection of suitable buildings upon the grounds: of the
State penitentiary for the better care and safety of the convicts confined
in the said penitentiary, appropriated the sum of one nae ‘ane
eighty thousand dollare to pay the cost of said buildings ; and,
Whereas, the building committee provided for in the said at have en-
tered into contracts with certain persons for the erection of said build-
ings; and,
Whereas, the said buildings under said contracts are being constructed,
but will not be completed on April second, nineteen hundred and four;
and,
Whereas, the Constitution provides in section one hundred and eighty-
six that “no money shall be paid out of the State treasury except in pur-.
suance of appropriations made by law, and no such appropriation shall
be made which is payable more than two years after the end of the session
of the general assembly at which the law is enacted suthorizing. the
same”; and,
Whereas, the limit provided for the payment of the said appropriation
will expire on April second, nineteen hundred and four; and,
Whereas, the said building committee have issued their warrants on
the auditor of public accounts for the sum of one hundred and thirteen
thousand three hundred and ninety-five dollars and forty-four cents,
leaving a balance due said contractors and others for services and mate-
rials when the said buildings are completed and the work accepted by
the architect of said building committee, of sixty-six thousand six hun-
dred and four dollars and fifty-six cents of the said appropriation of one
hundred and eighty thousand dollars; therefore,
1. Be it enacted by the general assembly of Virginia, That the said
building committee provided for in said act, approved April second, nine-
teen hundred and two, are hereby authorized to draw their warrants upon
the auditor of public accounts for the said sum of sixty-six thousand six
hundred and four dollars and fifty-six cents, for which purpose the said
amount is hereby appropriated out of any funds in the State treasury
not otherwise appropriated.
2. In view of the fact that an emergency exists, this act shall be in
force from its passage. ,
