Chap. 51.—An ACT to amend and re-enact section 3978 of the Code of Virginia,
as amended by an act approved January 2, 1904, which is chapter 549 of the
acts of the special session of 1902-’3-’4, relating to grand juries.

1. Be it enacted by the general assembly of Virginia, That section
thirty-nine hundred and seventy-eight of the Code of Virginia, as
amended by an act approved January second, nineteen hundred and four,
which is chapter five hundred and forty-nine of the acts of the special
session of nineteen hundred and two-three and four, be amended and re-
enacted so as to read as follows:
§ 3978. When special grand jury may be ordered; by whom and how.
A special grand jury may be ordered at any time by a circuit court of a
county or corporation, or corporation or hustings court of a corporation,
or the judge thereof in vacation, the jurors to be summoned from a list
furnished by the judge, and where a grand jury, regular or special, has
been discharged, the court, during the term, may impanel another grand
jury, which may be a special grand jury. A special grand jury may be
summoned for and impanelled at a special term of the court as well as at
a regular term.
2. The necessity of disposing of the criminal business creates an emer-
gency, and this act shall be in force from its passage.
