Chap. 197.—An ACT to authorize the city of Bristol, Virginia, to make additional
issues of bonds for water works improvemment.
Approved March 15, 1904.
1. Be it enacted by the general assembly of Virginia, That the council
for the city of Bristol, Virginia, may issue the bonds of the said city to
the amount not exceeding two hundred thousand dollars, in addition to
the issue of bonds authorized by act of assembly approved February four-
teenth, nineteen hundred and one, and the act of assembly approved April
second, nineteen hundred and two, for the purpose of improving, extend-
ing, and bettering its water works system. |
2. Said bonds shall be issued in denominations of not less than one
hundred dollars, nor more than one thousand dollars, at such times as the
council for the said city may determine, and shall bear interest at the rate
of not more than five per centum per annum, payable semi-annually, and
said bonds and interest shall be payable at such place as said council may
provide. Said bonds shall become due not later than thirty years after
the date thereof, and: shall be signed by the mayor and countersigned by
the clerk of said city. The bonds herein authorized to be issued may be
issued, anything in the charter of the said city of Bristol, Virginia, to the
contrary notwithstanding.
3. The said bonds shall constitute a lien upon the entire water works
svetem, so constructed, in addition to being pledged by the faith, credit,
and all properties belonging to the said: city, subject, however, to limita-
tions provided in section number one hundred and twenty-seven of the
Constitution of Virginia.
4. The council of the city of Bristol, Virginia, is hereby authorized
and directed to levy a special tax, in so far as allowed by law, upon all of
the taxable property in the said city of Bristol, Virginia, for the payment
of the principal and interest of the bonds hereby authorized. Said tax
shall be levied annually at the time, and in the manner taxes for the cur-
rent expenses of said city are levied, and the coupons attached to said
bonds may be receivable in payment of the taxes due the city of Bristol.
And the special taxes hereby authorized, and any other collections or
revenues reserved by the council of said city for same, shall not be used
for any purpose other than the payment of the principal and interest of
said bonds, or in making investments for the sinking fund for said prin-
cipal of said bonds.
5. The said bonds are to be issued when approved by the affirmative
vote of the majority of the qualified voters of said city, voting upon the
question of their issuance, at the general election next succeeding the
enactment of the ordinance or at a special election held for that purpose.
6. The said city of Bristol, Virginia, may, if deemed proper and ad-
visable by the council, join with the city of Bristol, Tennessee, in the
acquirement of a source of water supply and the construction of a system
as may be mutually agreed: to between said cities.
7. ra acts and parts of acts in conflict with this act are hereby re-
pealed.
8. This act shall be in force from its passage.
