Chap. 127.—An ACT to amend and re-enact section 2 of an act entitled “an act to
incorporate the town of Fairmount, Henrico county,” approved Mareh 10,
1902.

1. Be it enacted by the general assembly of Virginia, That section
two of an act entitled “an act to incorporate the town of Fairmount,
Henrico county,” approved March tenth, nineteen hundred and two, be
amended and: re-enacted so as to read as follows:
§ 2.. The officers of said town shall consist of a mayor, to be elected
every four years, and a council of five members, and such other officers
as the council may deem necessary. The said council shall hold office for
two years, and: said mayor and council shall receive no salary for their
services. Said council shall have power to enact all by-laws and ordi-
nances for the government of said town that it may deem necessary
and proper, and to prescribe penalties for violation of the same not ex-
ceeding fifty dollars for any one offence, and may subject the parent of
any minor for any such offence committed by such minor. All such fines
and penalties may be prosecuted and recovered in the name of said town.
The council shall have all the powers and be charged with all the duties
conferred and imposed by the general statutes of the State of Virginia
relative to towns, except so far as may be otherwise provided in this and
other sections of the charter of said town. The said council shall provide
for keeping its streets, sidewalks, and alleys in order, and for draining
the said town; to provide necessary facilities to supply the town with
water, sewerage, and light, and all other necessary improvements. And
for the purpose of paying the necessary expenses of the town the council
is hereby authorized to levy a tax on all the taxable property in said town
not exceeding fifty cents on the hundred dollars in value in any one year.
It shall be the duty of the board of supervisors of Henrico county to levy
annually on all the property located in the town of Fairmount the same
road tax levied on property in the balance of the county, and annually to
pay the sum thus collected to the treasurer of Henrico county, to be by
him placed’ to the credit of the said town, to be disbursed by it as its other
funds. The county of Henrico shall not be charged with the duty of
keeping in repair the roads and streets in said town.
Whenever three-fifths of the members of the council of the town of
Fairmount decide, by. a recorded vote, that it is to the interest of the town
so to do, the council of the said town shall have power to borrow money,
not exceeding the amount authorized by law, by the issue and sale of
bonds of said town. Said bonds may be either registered or coupon
bonds, or both; may be issued in such denominations as the council may
determine ; shall bear interest not exceeding 6ix per centum per annum;
shall be made payable not later than thirty years from their date; shall
be signed by the mayor of the town and the clerk of the council and bear
the corporate seal of the town; and may be sold or negotiated in such
manner as the council may determine: provided, said bonds shall not be
sold for less tham ninety per centum of their par value. The council
shall provide for the payment annually of the interest on said bonds and
for a sinking fund for their ultimate redemption.
2. An emergency arising requiring the immediate issue of bonds
lverein provided for, this act is declared to be an emergency act, and shall
be in force from its passage.
