Chap. 73.—An ACT to provide for the payment of the cost and expenses of prose-
cuting a certain criminal case removed from the county court of Patrick county,
and of a certain criminal case removed from the county court of Wythe county,
to the circuit court of the United States for the Western district of Virginia,
under section 643 of the revised statutes of the United States.
Approved March 3, 1903.
Whereas, A. H. Staples and others were indicted in the county court
of Patrick county for murder, and TP. I. Felts was indicted in the county
court of Wythe county for murder; and,
Whereas, both of said indictments, on the petitions of the defendants,
were removed for trial to the cirewt court of the United States for the
Western district of Virgima, under the provisions of section six hundred
and forty-three of the revised statutes of the United States: and,
Whereas, J. M. Hooker, attorney, and H. M. [euser, attorney, rendered
certain services and ineurred certain expenses in the prosecution of said
cases In the said cirewit court of the Umited States at the request of the
attorney-general; and,
Whereas, there is no provision of law for the payment of said services
and expenses, or for the payment of the attendance of withesses necessary
for the protection of the interests of the Commonwealth in said eases ;
therefore,
1. Be it enacted by the general assembly of Virginia, That the sum of
one hundred dollars is hereby appropriated, to be paid out of the treasury,
to the said J. M. Tooker, attorney, to cover his expenses and services in
ecnnection with the trial of the said case of Commonwealth versus A. TH,
Staples and others. in the cirewit court of the United States at Lynehbure,
transferred and tried in the said circuit eourt at Danville in November,
nineteen hundred and two. And the sum of fifty dollars is hereby appro-
priated, to be paid out of the treasury, to If. M. Ifenser, attorney, for his
services and expenses to date in connection with the said case of Com-
monwealth versus T. L. Felts, in the circuit court of the United States
at Lynchburg. And such sum as may be necessary for that purpose is
hereby appropriated, to be paid out of the treasury. to the witnesses who
attended upon behalf of the Commonwealth wpon the said cases of Com-
monwealth versus A. H. Staples and others, and Commonwealth versus
T. L. Felts. in the circuit court of the United States, to be paid as fol-
Jows: To each witness a per diem of one dollar and fifty cents for each
dav of actual attendance upon said court, and mileage of five cents per
mile for every mile of necessary travel in going to and returning from
said court; said witnesses to be paid upon accounts certified and approved
by the attorney for the Commonwealth in cach case, and by the attorney-
general.
The auditor of publie accounts is hereby authorized and instructe
to draw luis warrants woon the treasury in favor of the parties entitled t
be paid the above compensation and expenses, or their assigus, uper
accounts certified and approved as above prescribed,
This ac shall be in force from its passage.
