Chap. 230.—An ACT to amend and re-enact an act entitled an act authorizing the
board of supervisors of Chesterfield county to create a general road fund, and
to provide for the permanent improvement of roads, approved April 2, 1902, and
to create an advisory road board and to provide for the appointment of a
county superintendent of roads.
Approved May 14, 1903.
1. Be it enacted by the general assembly of Virginia, That the board
of supervisors of Chesterficld county shall create a general road fund by
setting apart and appropriating thereto one-half of the road fund of each
district of said county in each year, including the levies for the year nine-
teen hundred and one, which general road fund and such other moneys
as may be lawfully appropriated thereto shall be expended only towards
the permanent improvement of the public roads of said county as is con-
templated by this act.
2. There is hereby created a hoard, to be known as the advisory road
board. The said advisory road board shall consist of one member from
each magisterial district, to be appointed on or before the first day of
July, nineteen hundred and three, by the judge of the county court, in
term time or in vacation, and annually thereafter by the judge of the cir-
cuit court of the county of Chesterfield, in term time or in vacation. Th
said advisory road board shall have authority, and it shall be its duty, t
designate the roads in each district to be improved under the provision
of this act, and specify the character of improvement to be made on eac!
road, and the board of supervisors shall thereupon cause such road o
roads, or parts of roads, in said county as said advisory road board ma:
from time to time, have so designated to be built, improved, or repaire
in @ permanent manner, or as nearly so as may be ‘practicable.
3. The board of supervisors shall, within thirty days after this act sha!
have been approved by the governor, and annually thereafter, appoint :
county superintendent of roads for the term of one year from the date c
his appointment, and, from time to time, fix his compensation and pre
scribe his duties, where they are not prescribed by this act; and said boar
of supervisors may remove such superintendent from office and may
any Vacancy in said office, and said board of supervisors may. from tim
to time, if deemed by it necessary, appoint a deputy or deputies for sai.
superintendent, upon his request, for such times as it may direct, but ne
extending beyond the term of the superintendent, and fix the compenss
tion of such deputies; and said board shall have authority to emplov a
other agents or engineers as it may deem necessary, prescribe their dutie
and fix their compensation, and shall have full power to purchase ma
chinery, teams, supplies, and materials, and perform all other acts neces
sary to carry out the spirit of this act. It shall also have authority to for
bid the public from traveling on any road, or portion of road, while th
same is being built, improved, or repaired; and thereafter when suc
travel would by weather conditions, in the opinion of said board, great
damage such road. It may make all necessary contracts, and shall r
quire proper bonds from all agents and contractors for faithful per
formance of duties or contracts. All work and contracts shall be don
and performed to the satisfaction of the board of supervisors, and a
moneys shall be paid by the warrant of said board.
4. The member of the advisory road board and the member of th
board of supervisors from each magisterial district, together with t!
county superintendent of roads, shall constitute a district road board fc
such magisterial district, which board shall have the immediate contre
and supervision of all work done or performed on the roads of the di:
tricts under the provisions of this act.
5. The said board of supervisors sha]] have authority, if, in its opinior
it shall be judicious to do so, to require all persons who may use wagon:
carts, or other vehicles in said county to provide such wagons, carts, o
vehicles with tires of such width as said board may prescribe, upon suc
conditions as said board may prescribe, and may prescribe such penalt
for the failure of any person to comply with such requirement or orde
as said board may deem best.
6. The said board of supervisors shal] have the authority to appropriat
to the general road fund provided for by this act any balance that ma:
remain at the end of any fiscal year to the credit of the county fund o
levy, or so much of said balance as said board may deem it wise to appro
priate ; and said board may at any time appr opriate to said general func
such sum from the county levy as it may deem necessary and proper.
%. No supervisor or other public officer, member of the advisory board,
superintendent of roads, or deputy or engineer, shall have any interest
in any work or contract done or had under the provisions of this act.
8. The members of the advisory board hereby created, and the super-
intendent of roads, shall qualify by taking the usual oath for the faithful
performance of their duties.
9. The board of supervisors may, in its discretion, allow the members
of the advisory board such compensation for services performed as it may
deem just, but if such board shall decline to allow any compensation,
there shall be no appeal from its decision.
10. All acts and parts of acts inconsistent with this act are hereby re-
pealed.
11. This act shall be in force from its passage.
