Chap. 219.—An ACT to amend and re-enact section 35, chapter 4, of an act en
titled an act to provide a new charter for the town of Wytheville. approved Feb
ruary 26, 1886, as amended and re-enacted by an act approved March 1, 188s.

Be it enacted by the general assembly of Virginia, That) section
thirty-five, chapter four, of an act entitled an act to provide a new char-
ter for the town of Wytheville, approved February twenty-sixth, eighteen
hundred and eighty-six, as amended and re-enacted by an act approved
March first, eighteen hundred and ninety-eight, be amended and m
enacted so as to read as follows:
$35. General duties and powerss—The treasurer may be required to
keop all monevs in his hands belonging to the tewn in) such place oF
Places of deposit as the council may provide by ordinance, order, es
tablish, or direct. Such money shall be kept separate and distinet from
his own money. And he is expressly prohibited from using, direetly or
indirectly, the corporation money or warrants in his custody or keep-
inv for is own use and benefit, or that of any person or persons whom-
soever, and any violation of this provision shall subject him to imme-
liate removal from office. In case of his removal, the town council
hall clect a qualified person to fill said office for the unexpired term.
fhe said treasurer is empowered to seleet one or more persons as his
l-puty or deputies, as the case may be, to assist him in collecting the
“venues from all sources of taxation, and so forth, within the said
own of Wytheville, for its use and benefit, and be wholly responsible
o said town for their official acts.
The treasurer shall receive such compensation as is now provided
wv the council: provided, that he shall not receive an amount greater
han one thousand dollars per annum for his services in collecting taxes,
neluding water and hght tickets: and provided, further, that he shall
rot receive more than fifty dollars per annum for the water and light
ickets of the town. No person shall be allowed to qualify a second
ime as treasurer unless, and until, he shall satisfactorily settle his ae-
counts as treasurer for the preceding term, and if such settlement. be
not made on or before the regular time for his entering upon the duties
of another term, the office shall be considered vac ant, and the vacancy
shall be filled as hereinbefore provided.
