Chap. 64.—An ACT to amend and re-enact section 2 of the charter of the
Peninsula water company.
Approved February 11, 1901.
1. Be it enacted by the general assembly of Virginia, That section
second of the charter of the Peninsula water company, a corporation
duly chartered by order of the judge of the circuit court of the city of
Newport News in the state of Virginia, entered in vacation on the

eighteenth day of August in the year nineteen hundred, be amended and
re-enacted so as to read as follows—to-wit:
§ 2. The said company shall have full power and authority to acquire
lands, and, upon payment of just compensation as provided by law, to
construct, use, employ, lav, and locate, on any plan it may approve,
dams, reservoirs, cisterns, force pumps, engine, pipes, and any and all
fixtures, appurtenances, and appliances proper, necessary, or desirable
for the drawing, storage, conveyance, and distribution of water for public
or private use within the limits of any of the cities, towns, counties, and
other places named in the first section of this charter, as may be neces-
sary, desirable, or proper in the conduct of its business, together with
the right to lay all necessary pipes, main and lateral, and make the neces-
sary openings and excavations therefor. And the said company shall
have full power and authority, with the consent of the county court
of the respective counties named in the first section of this charter, to lay
all necessary pipes, main and lateral, for the conveyance and distribu-
tion of water along, on, and under the public roads within the limits
of the said countics; and, with the consent of the council of the respec-
tive cities and towns in the first section named, to lay all necessary
pipes, main and lateral, for the conveyance of water along, on and under
the streets and alleys of said cities and towns, subject, however, to the
fee simple rights of adjacent land owners in and to said roads, streets,
and alleys, which right of way the company may acquire by gift, pur-
chase, or condemnation in the manner prescribed by sections twelve
hundred and eighty-eight and twelve hundred and eighty-nine of the
code of Virginia. And said company is further authorized and empow-
ered to lay, locate, and construct its pipes for the conveyance and dis-
tribution of water across Hampton river and Mill ereck, in the said
county of Elizabeth City, above or beneath the waters of said river and
creek: provided, that said pipes shall not in any way obstruct free
navigation thereof. And for the purposes of its charter, the said com-
pany shall he, and is, hereby expressly invested with all the powers,
rights and privileges and franchises conferred on companies incorpo-
rated for works of internal improvement by chapter forty-six of the code
of Virginia and the acts of the general assembly of Virginia amendatory
thereof.
3. This act shall be in force from its passage.
