Chap. 338.—An ACT authorizing the board of supervisors of Botetourt county
to devote proceeds of the tax on dogs in said county to the payment of
claims for sheep killed or severely wounded by dogs in said county.
Approved February 16, 1901.
1. Be it enacted by the general azsembly of Virgiria. That the board
of supervisors of Botetourt county are hereby authorized to devote the
proceeds of the tax on dogs in said county to the payment of claims for

sheep killed or severely wounded by dogs in said county, and to turn over
any surplus after the payment of said claims to the district school or road
funds, in proportion to the number of dogs listed in the respective dis-
tricts. It shall be the duty of any justice of the peace of suid county, on
complaint under oath of any owner of sheep or his agent, that his sheep
have been killed or severely wounded by dogs (not his own), to issue a
summons to three frecholders in the neighborhood, any two of whom may
act, who, being first duly sworn, shall go forthwith upon the premises
where said sheep may be and examine into the facts and justice of the
complaint and appraise the damages sustained by the owner, such ap-
praiscment not to exceed the amount per head at which such sheep were
last assessed by the commissioner of the revenue, or were not assessed,
but acquired afterwards, not to exceed the value of said sheep according
to the opinion of said freeholders given under oath, and return a cer-
tificate of the same under their hands to the owner of said sheep or his
agent, and a like certificate to the clerk of the county court, who shall
present it to the board of supervisors at their next meeting.
All acts and part of acts in conflict with this act are hereby repealed.
3. This act shall be in force from its passage.
