Chap. 320.—An ACT to transfer to the board of supervisors of Frederick
county the state’s interest in the north Frederick turnpike.
Approved February 16, 1901.
Whereas by divers acts of the general assembly of Virginia, the North
Frederick turnpike company was legally incorporated, and in pursuance
of said charter of said company the said turnpike was constructed from
a point at or near the house of Frederick B. Jenkins, in the county of
Hampshire, West Virginia, and through the town of Gainsborough to
the town of Winchester; and
Whereas the state of Virginia now owns a majority of the stock of said
turnpike company, from which it has never received any dividends;
therefore,
1. Be it enacted by the general assembly of Virginia, That the board
of public works be, and they are, hereby authorized and directed to
transfer all the right, title and interest of the state of Virginia in said
road, or so much thereof as lies within the county of Frederick, to the
board of supervisors of Frederick county, and their successors, together
with all the bridges, toll-houses and other property appertaining thereto.
2. It shall be the duty of the said board of supervisors to take charge
of and operate as much of said road as lies within said county, and cause
the same to be put and kept in repair out of the proceeds arising from
the tolls of the same. It shall forthwith appoint and employ such offi-
cers and agents as may be needed for the eflicient operation of said road,
and may remove the same from time to time as the said board may deem
proper. It shall cause the tolls to be faithfully collected within the rates
prescribed by law, and regularly applied to the maintenanee and im-
provement of said road, and if there be any surplus revenue after said
road is kept up in tollable condition, three-fifths of said surplus revenue
shall be placed to the credit of district funds of Gainsborough and Stone-
wall districts of Frederick county, to be used by the boards of road com-
missioners of said districts, in equal proportions in their respective dis-
tricts. The residue of said surplus revenue shall be paid to the private
stockholders of said company in the manner prescribed by statute for the
distribution of dividends. Said board of supervisors shall have the same
powers and rights as have heretofore been held and exercised by the
board of public works.
3. And the said board of supervisors shall have the right to use any
portion of the tolls of said road which have heretofore been collected
or which may hereafter be collected for the purpose of macadamizing any
part of said road lying within the county of Frederick.
4. This act shall be in force from its passage, but is subject to revo-
cation by act of the legislature.
