Chap. 317.—Au ACT to amend and re-enact section 30 of an act entitled an
act to provide a new charter for the city of Charlottesville, Virginia, and
to repeal all acts inconsistent therewith, approved March 3, 1900.
Approved February 16, 1901.
Whereas there is some doubt as to the powers of the mayor of the city
of Charlottesville to perform the duties of a justice of the peace within
said city and within a mile of the corporate limits thereof; and it is de-
sired to give him full power in that respect; and
Whereas it is also desired that said mayor shall have full authority to
qualify any special police officers he may appoint; therefore,
1. Be it enacted by the gencral assembly of Virginia, That section
thirty of an act entitled an act to provide a new charter for the city of
Charlottesville, and to repeal all acts inconsistent therewith, approved
March third, nineteen hundred, be amended and re-enacted so as to read
as follows:
§ 30. The mayor shall be chief executive officer of the city; he shall
take care that the by-laws, ordinances. acts and resolutions of the council
are faithfully executed. He shall see that the duties of the various
officers are faithfully performed. He shall have power to investigate
their acts, and have access to all books and documents in their offices
relating to the city, and may examine them and their subordinates on
oath ; he shall be ex-oflicio a conservator of the peace within the city and
within a mile of the corporate limits thereof, and shall, within the city
and within a mile of the corporate limits of same, exercise all the powers
vesied in a justice of the peace for the city: he shall have control of the
police of the city; may appoint special police officers when he deems it
necessary, and shall have full authority to swear in or qualify anv and
all police officers appointed by him. He shall, from time to time, reeom-
mend to the council such measures as he may deem needful for the wel-
fare of the city. In case of the absence or inability of the mayor, the
president of the council: or. in his absence or inability. some other mem-
her designated by the council shall act as mayor and possess the same
powers and discharge the same duties as are possessed and discharged by
the mayor when actually on duty. In case a vacancy shall occur in the
office of mayor, the president of the council shall discharge the duties ot
the office until the next regular meeting of the council, at which time
the vacancy shall be filled by the council. The mavor shall receive a com-
pensation for his services, to be fixed by the council, which shall not be
increased or diminished for the term for which he shall have been elected :
but said compensation shall not be less than four hundred dollars per
annum or more than six hundred dollars per annum.
2. This act shall be in force from its passage.
Whereas under and by virtue of the terins of an act approved the fifth
day of March, nineteen hundred, creating the board of coinmissioners of
valuation of personal property and income, consisting of the auditor of
public accounts, second auditor and treasurer, said board appointed
Ivanhoe Selater secretary; and
Whereas the aforesaid Ivanhoe Sclater discharged the duties of said
secretary for the term of one month and received no compensation there-
for; and
Whereas it is proper he should be paid for his services: therefore,
1. Be it enacted by the general assembly of Virginia, That the auditor
of public accounts is hereby authorized and directed to draw his war-
rant op the treasurer of Virginia in favor of Ivanhoe NSclater for the
sum of twenty-five dollars as compensation for his services rendered said
board.
2. This act shall be in force from its passage.
