Chap. 170.—An ACT to authorize the county court of Pulaski county to ac-
quire for highway and road purposes from the Norfolk and Western railway
company part or parts of the right of way of its railroad between New River
depot and Back Creek, in Pulaski county, and to authorize the board of
directors of the Norfolk and Western railway company to abandon the same
for railroad purposes.

1. Be it enacted by the general assembly of Virginia, That the county
court of Pulaski county, Virginia, be, and hereby is, authorized to acquire
for public highway and road purposes, without expense to the county, but
with the consent of the board of directors of the Norfolk and Western
railway company, part or parts of the right of way of the Norfolk and
Western railway company now used by it on its New river division for
railroad purposes between the New river depot and Back creck, Pulaski
county, Virginia, and in order to carry the purposes of this act into
effect the board of directors of the Norfolk and Western railway com-
pany be, and hereby is, authorized from time to time to abandon for
railroad purposes such part or parts of its railroad between New river
depot and Back creek, in Pulaski county, Virginia, as it may determine,
so that, however, the railway company may in such event use in the place
and stead thereof, which it is hereby authorized so to do, its New river
connecting branch for all business which otherwise should or would be
done via the part or parts of its railroad so abandoned, and said railway
company shall dedicate to the public, for highway and road purposes,
in such manner as shall he approved by the county court of Pulaski
county, every part or parts of the right of way so abandoned as the said
county court may desire to acquire for highway and road purposes, and
the board of road commissioners of said county shall take charge of the
same as of other public roads, and said railway company may sell, lease
or otherwise dispose of to the adjacent land owners the remainder of the
right of way so abandoned: provided, however, that passenger train ser-
vice to the full extent now furnished Radford, via the section of the rail-
road which may be abandoned under the provisions of this act, shall con-
tinue to be furnished, via the New river connecting branch of the Nor-
folk and Western railway company: provided further, that the said rail-
way company in abandoning its roadway between the points herein desig-
nated shall not remove or tear down the two trestles of the said
present road, but after taking its rails and ties therefrom leave the said
trestles and road-bed intact for the use of the said county road herein
provided for.
2. Nothing in this act shall be construed as interfering with or im-
pairing any right of reversion or other estate which any person may have
im any part of the right-of-way land which is abandoned and not dedi-
rated to the public for highway purposes.
3. This act shall be in force from its passage.
