Chap. 162.—An ACT to authorize and empower the board of supervisors of
New Kent county to build, construct, and maintain a wharf on the York
river, at some point on the New Kent shore of Fork river, between Plum
point and Weir creek.
Approved February 14, 1901.
1. Be it enacted by the general assembly of Virginia, That the board
of supervisors of the county of New Kent be, and they are, hereby au-
thorized and empowered as hereinafter provided, if, in their judgment.
they deem it advisable so to do, to cause to be built and constructed a
suitable wharf with the necessary abutments and approaches thereto
from the shore to the channel of the York river, at some point on said
river to be selected by said board between Plum point and Weir creek,
the total cost of the same not to exceed three thousand dollars.
2. hat the said board of supervisors is authorized to purchase or con-
demn any rights and sites necessary therefor on the New Kent shore of
said river in the manner provided by statute.
3. The board is hereby given full power to construct said wharf in such
manner as may seem to them best for the public interest to carry into
effect the provisions and purposes of this act; and after said wharf shall
have been accepted by said board of supervisors they may use any moncy
in the treasury of said county not otherwise appropriated for the build-
ing of said wharf; and if there be not sufficient money in the treasury
of said county to construct said wharf, the board of supervisors are hereby
authorized, if they deem it best, to issue county bonds not exceeding the
amount of three thousand dollars to be used exclusively for the purpose
of building said wharf.
4. The board of supervisors is hereby authorized and empowered to
receive private subscriptions to aid in constructing and building said
wharf, said subscriptions, however, to be received and considered as a
gift to said county; and when the board of supervisors shall have ascer-
tained by the receipt of sealed proposals, or otherwise, that the cost of
said wharf, together with the necessary abutments and approaches
thereto, can be secured at a total cost to said county not exceeding the
sum of three thousand dollars, exclusive of said subscriptions, then the
said board of supervisors shall be authorized to contract for the same;
and, after the construction of said wharf, tolls and charges thereon shall
be fixed by the county court of New Kent in the manner now prescribed
by law for the establishment of rates for ferries by county courts.
5. The title to said wharf and all rights pertaining to the same shall
be in the county of New Kent, and said wharf shall be and remain the
property of said New Kent county in like manner as the public bridges of
said county now are, and shall be maintained, repaired, and kept in order
in like manner as the public bridges of said county are now maintained.
6. All acts or parts of acts in conflict with this act are hereby repealed
7. This act shall be in force from its passage.
