Chap. 144.—An ACT to amend and re-enact section 2136 of the Code of Vir-
ginia as amenaed by an act entitled an act to amend and re-enact section
2136 of the Code of Virginia as to right of owners in any creek, etc.,
within his survey, approved March 7, 1900.

1. Be it enacted by the general assembly of Virginia, That section
twenty-one hundred and thirty-six of the code of Virginia, as amended
by an act entitled an act to amend and re-enact section twenty-one hun-
dred and thirty-six of the code of Virginia, as to right of owners to
plant oysters in any creek, and so forth, within his survey, approved
March seventh, nineteen hundred, be amended and re-enacted so as to
read as follows:
$2186. Right of owners to plant ovsters in any creek, and so forth.
within his survey: exception —If any creck, cove or inlet within the
jurisdiction of this commonwealth makes into or runs through the lands
of any person and is comprised within the limits of his lawful surve
such person or other lawful occupant shall have the exclusive right
use said creek, cove or inlet for sowing or planting oysters or oth
shell fish. This section shall not apply to the county of Mathews; bi
the third section of chapter two hundred and fifty-four, acts of eig!
teen hundred and cighty-three and cighty-four shall continue in for
in said county, except as to the waters of Milford haven and Ho
harbor, said waters of said Milford haven and Horn harbor shall |
subject in all respects to the provisions of section twenty-one hundre
and thirty-seven of the code of Virginia, as amended by acts heretofo
passed.
2. This act shall be in force from its passage.
