Chap. 138.—An ACT to authorize and empower the town council of the town
of Clintwood to make assessments upon all abutting land owners on Main
street of said town of Clintwood for sidewalks and provide mode for col-
lecting same.
Approved February 14, 1901.
1. Be it enacted by the general assembly of Virginia, That the town
council of the town of Clintwood be, and it is, hereby empowered and
authorized to make an assessment upon all the abutting land owners
upon Main street of said town of Clintwood sufficient to lay sidewalks
in front of each of their respective lots or parcels of land fronting on
Main street, and the said town council is further authorized and em-
powered to collect, and shall by ordinance authorize its treasurer to pro-
ceed to collect the cost and expense of laying said sidewalks as pro-
vided in said ordinances, in the same manner as other taxes are collected,
and on such terms as the said council may provide: and provided, fur-
ther, if said assessments cannot be collected by distress or levy made by
said treasurer, then said council shall direct suits or actions in the name
of said town to be instituted against said abutting land owners for the
amounts that may be due from each or any one of said abutting land
owners on account of said assessments; and the said assessment shall
be a lien for the amount due from such land owners on their respective
lots or parcels of land aforesaid, as other taxes: and provided, further,
that the said town council may, in its discretion, and in lieu of the above-
said assessment and collection, allow each of said abutting land owners
to put down his or her sidewalk: provided, said land owner shall put
down such work as will be accepted by said council.
2. This act shall be in force from its passage.
