Chap. 110.—An ACT to amend the charter of the trustees of the Upper Ap-
pomattox company, and to render the property of the said company subject
to state, county, and municipal taxation, and for other purposes.

Whereas the extension of facilities for transportation by railroad and
otherwise has for many years superseded the use of the Appomattox river
ag a public highway above the point on the said river known as Caudles,
and has rendered it inadvisable to require the trustees of the Upper
Appomattox company to expend the large sums of moncy necessary to
maintain the navigation of the said river above the said point as provided
for in its charter, and the said company, in consideration of the relief to
be afforded by a release of its obligations to expend such money in main-
taining said navigation, is willing to give up and release any and all ex-
emptions from taxation granted under its charter, and to permit all of
its property to become liable to state, county, and municipal taxation as
other like property in the state for the vear nineteen hundred and one
and thereafter; therefore,
1. Be it enacted by the general assembly of Virginia, That the trustees
of the Upper Appomattox company be, and they are, hereby authorized
to discontinue the further extending, clearing, and maintaining of the
navigation of the Appomattox river above the point thereon known as
Caudles, until they shall be required to resume the same by the further
action of the legislature, but during said time the said company shall
not be entitled to demand or collect any tolls or other charges from per-
sons using said river above said point for navigation purposes, and during
said time the said trustees of the Upper Appomattox company shall not
he liable for any damage that may oecur to any person by reason of its
failure to clear, improve or maintain the navigation of the said river
above the point on said river known as Caudles.
2. The trustees of the Upper Appomattox company are hereby au-
thovized to change the terminus of their canal for navigation purposes
from the basin in the citv of Petersburg to such other point along the
line of their canal, in the city of Petersburg or the county of Dinwiddie,
as may to them seem best for the interest of the company, and they may
hereafter, without further legislation, reopen the canal for navigation
purposes to the present site of their basin in the city of Petersburg,
whenever, in their judement, the interests of the company will be thereby
promoted. The principal office of the company, however, shall be and
remain in the city of Petersburg.
3. This act shall not take effect until it shall have been aecepted by the
stockholders of the said trustees of the Upper Appomattox company in
general mecting assembled, and a copy of the resolution of the said
stockholders accepting the same, certified by the president and secretary
of the company, shall have been filed in the office of the secretary of the
commonwealth, nor until the said corporation shall surrender all its
rights of exemption from county, state, and municipal taxation granted
hy its charter or otherwise. And the acceptance of this act by the said
stockholders shall be taken and construed as a surrender and release of
all its rights of exemption from taxation aforesaid, and as the consent
of the said corporation, that its property shall be liable to state, county,
and municipal taxation as other property of Jike kind, ineluding the
year nineteen hundred and one: but all other rights, privileges and im-
munities hereby granted the said company by the several acts of the
general assembly with reference thereto, and which are now existing, are
hereby expressly retained and confirmed to the said company.
